Zaliwski

Date: the Saturday after the feast of St Valentine the Martyr in the Year of Our Lord 1743.

The well-born (Gen.): Andrzej Jaszowski, vicegerent of Łuków, Antoni Smoniewski, Franciszek Iwanowski, Franciszek Chojecki, Wojciech Bzowski, Franciszek Wielgórski, Ignacy Zaliwski, Wojciech Kowalewski and Maciej Świderski [the reading of the given name uncertain] – heirs and possessors of the estates of the village of Bzów – in their own name and in the name of the other co-heirs and co-possessors of those estates of the village of Bzów, for whose ratification they stand surety, all being of sound mind and body, deposed that the ordinance (agreement) concluded among themselves, drawn up and written down under the date at Bzów on the twenty-ninth day of December in the Year of Our Lord 1742, concerning certain conditions and the order of the estates, signed with the hands of the deponents and of others, secured by a penalty of fourteen Polish marks – as appears from the copy of that ordinance, which is here held as entered and which is in the records – they confirm and approve in all its parts. And this under a penalty of fourteen Polish marks and the present forum, and in time of interregnum – of the Łuków confederate court (sąd kapturowy).

The magnificent (Magn.) Józef Rzewuski, sword-bearer of the Mielnik land, son of the late well-born (Gen.) Stefan Rzewuski, cup-bearer of Drohiczyn, grandson of the former well-born (Gen.) Feliks Beydo Rzewuski, clerk of the Mielnik castle court, and nephew (sister's son) and natural successor of the late well-born (Gen.) Helena née Rzewuska Zaliwska, wife of the well-born (Gen.) Wojciech Zaliwski, who departed this world without issue, being of sound mind and body, deposed that to the well-born (Gen.) Antoni Rzewuski, treasurer of Mścisław, and to his successors he cedes and yields the sum of eight thousand Polish złoty. That sum was contracted by the late well-born (Gen.) Wojciech de Wołyńce Zaliwski and inscribed to the well-born (Gen.) Helena Rzewuska, the deponent's aunt, daughter of the late well-born (Gen.) Feliks Beydo Rzewuski, clerk of the Mielnik castle court, by way of a simple debt upon his estates, before the Drohiczyn castle court records on the Monday before the feast of St Margaret Virgin and Martyr in the Year of Our Lord 167[0] [the reading of the year uncertain]; and after the death without issue of the said well-born (Gen.) Helena née Rzewuska Zaliwska it fell to the deponent by divine right and natural succession. The cession embraces all the conditions, points, clauses, articles, bonds and securities of that original inscription, as also of the supplementary inscription, officially confirmed by right of cession in his favour by the well-born (Gen.) Franciszek Łaski before the present records on the Monday after Misericordia Sunday in the Year of Our Lord 1741. Having received sufficient satisfaction from the hands of the present cessionary, he cedes every right; giving power to receive that sum, to give a quittance for what is received and to pursue it in the ordinary course of law in every court and office.

The noble (Nob.) Ignacy Zaliwski, son of the late noble (Nob.) Andrzej, being of sound mind and body, deposed that to the noble (Nob.) Fabian Chromiński and to his successors he mortgages the estates subject to his rights, that is:

1) first – two strips of arable, beginning at the plot called Probowszczowa [uncertain reading] and running towards the place called Przecięcie, between the baulks of the noble (Nob.) Franciszek Wielgórski on the one side and of the noble (Nob.) Mikołaj Sobiczewski [uncertain reading] on the other; 2) secondly, in the second field – two strips of arable, beginning at the Dębowa road and running towards the Zbuczyn boundaries; further, in that same field and place, one strip of arable, beginning at [the tract – the name read with uncertainty] and running towards the Zbuczyn boundaries; 3) thirdly, in the third field – five strips of arable, beginning at the fields called [the name illegible] and running towards the Tchórzew boundaries, between the baulks of the noble (Nob.) Andrzej Ludowski [uncertain reading] on the one side and of the noble (Nob.) Franciszek Iwanowski on the other; moreover in that same field one strip with half of a second, of a like length and between those same baulks –

situated and lying in the hereditary village of Bzów, with everything, for the sum of forty Polish złoty, from now for three years, with the term falling at the feast of St Adalbert the Bishop, and thereafter from one three-year term to another and to the same feast, until redemption. He consented to intromission forthwith and promised warranty, and this under a like penalty of forty Polish złoty, for which he appoints the present forum.

The noble (Nob.) Zofia Ługowska, daughter of the late noble (Nob.) Grzegorz Ługowski begotten with the late noble (Nob.) Marcjanna née Iwanowska, by her first marriage the wife of the late noble (Nob.) Antoni Borkowski, and by her second and present marriage the wife of the noble (Nob.) Antoni Ługowski, with the assistance of that same husband of hers, being of sound mind and body, deposed that to her – by title of the dowry and trousseau, out of the paternal and maternal estates, that is those which fell to her after the noble (Nob.) Marcjanna née Iwanowska, the deponent's mother, out of the estates of Iwanów and Bzów and devolved upon her after her mother's death – sufficient and full satisfaction has been rendered through the hands of the noble (Nob.) Ignacy Zaliwski, her stepfather (vitricus); wherefore she gives a quittance to him, and from those estates she withdraws and renounces them; moreover the right which belongs to her in them she yields up and cedes to the noble (Nob.) Ignacy Zaliwski and to his successors, by virtue of the present deposition.

The noble (Nob.) Antoni Ługowski, son of the noble (Nob.) Michał, being of sound mind and body, deposed that to the noble (Nob.) Zofia Ługowska, his wife of the present marriage, and to her successors – for the sum of four hundred Polish złoty, out of the original sum of four hundred Polish złoty, deposed to him and inscribed before the present records under the day of the feast of St Elizabeth the Queen in the year 1743 [19 November 1743] by way of a simple debt, and falling to him and paid out by title of the dowry through the hands of the noble (Nob.) Ignacy Zaliwski, the stepfather [of his wife] – having accepted satisfaction, he gives a quittance for the payment of that same sum; leaving [the inscription in force] as to the remainder of the sum [uncertain reading].
