Kowalewski

Date: the Saturday after the feast of St Valentine the Martyr in the Year of Our Lord 1743.

The well-born (Gen.): Andrzej Jaszowski, vicegerent of Łuków, Antoni Smoniewski, Franciszek Iwanowski, Franciszek Chojecki, Wojciech Bzowski, Franciszek Wielgórski, Ignacy Zaliwski, Wojciech Kowalewski and Maciej Świderski [the reading of the given name uncertain] – heirs and possessors of the estates of the village of Bzów – in their own name and in the name of the other co-heirs and co-possessors of those estates of the village of Bzów, for whose ratification they stand surety, all being of sound mind and body, deposed that the ordinance (agreement) concluded among themselves, drawn up and written down under the date at Bzów on the twenty-ninth day of December in the Year of Our Lord 1742, concerning certain conditions and the order of the estates, signed with the hands of the deponents and of others, secured by a penalty of fourteen Polish marks – as appears from the copy of that ordinance, which is here held as entered and which is in the records – they confirm and approve in all its parts. And this under a penalty of fourteen Polish marks and the present forum, and in time of interregnum – of the Łuków confederate court (sąd kapturowy).

The nobles (Nob.) Wojciech and Dorota née Ługowska Kowalewski, husband and wife, being of sound mind and body – and namely the wife with the assistance of that same husband of hers – deposed that to the noble (Nob.) Andrzej Kowalewski, their son, and to his successors their estates – namely the father's, acquired by inheritance, and the mother's, covered by the rights obtained from that same husband of hers – that is their whole and entire share in the homesteads, the buildings, gardens, orchards, arable, fields, meadows, woods, forests, groves, copses, rivers, streams and in the other appurtenances and appendages of that share, lying and situated in the village of Bzów –

reserving, however, to themselves the deponents a life estate upon the half of that share –

with every right they give and donate; they consent to intromission from now on for the future and submit to the court, and this under the land-law damages and under the jurisdiction of the present office.

The noble (Nob.) Kazimierz Bzowski, son of the noble (Nob.) Wojciech, being of sound mind and body, deposed that to the noble (Nob.) Stanisław Bzowski and to his successors he gives and donates his acquired estates, that is five strips of arable, beginning at the place called [the name illegible] and running towards the village road, between the baulks of the noble (Nob.) Wojciech Kowalewski on the one side and of the donee himself on the other, situated and lying in the hereditary village of Bzów, with everything. He consented to intromission forthwith and promised warranty, and this under the land-law damages and the present forum.

The noble (Nob.) Wojciech Kowalewski, son of the late noble (Nob.) Bartłomiej [Kowalewski], being of sound mind and body, deposed that to the noble (Nob.) Małgorzata Kowalewska, [his] daughter, the sum of two hundred Polish złoty — out of the original sum of two hundred and forty Polish złoty, yielded up by the noble (Nob.) Tomasz Ługowski before the present records on the Monday after Invocavit Sunday in Lent in the Year of Our Lord 1737 to him, the deponent, and extending to the estates expressed in the original inscriptions — together with all the conditions of those same inscriptions, as far as the transferred sum of two hundred Polish złoty is concerned, he yields up and cedes. He consented to intromission, governing himself by the common law, and this under a penalty of two hundred Polish złoty, for which he appoints the present court.
