The well-born (Gen.): Józef Kobylański, son of the late well-born (Gen.) Jan Kobylański, on the one side, and Marcin Tchórzewski, son of the late well-born (Gen.) Stanisław Tchórzewski called Szymańczyk, on the other side, being of sound mind and body, deposed – Józef Kobylański in his own name and in the name of the well-born (Gen.) Antoni, Walenty and Jan, and likewise of Marianna, a widow, and of Zofia, wife of the well-born (Gen.) Paweł Paskudzki, Kobylański, his brothers and sisters german; and Marcin Tchórzewski in his own name and in the name of the well-born (Gen.) Ignacy and Antoni Tchórzewski, and also of the daughter of Szymon Tchórzewski, his sisters german – for whom they mutually stand surety and bind themselves in the fullest form of law – that for the settling of the suits and actions mutually brought against each other before the court of the Łuków castle office they choose, appoint and obtain as supreme judge and superarbiter the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw and clerk of the Łuków castle court. That magnificent (Magn.) superarbiter, together with the Lords Arbiters – two called by each side – is to come upon the ground of the Tchórzew Ziemiański estate on the Tuesday after the feast of the Conversion of St Paul the Apostle of the current year, that is on 29 January, and first of all to examine the lawfulness of the suit obtained by the party of the above-named Tchórzewski upon the Kobylański estate and of the delivery (intromission) subject to execution by virtue of it; that suit he is to dissolve, cancel or confirm, and also to rule on the remission of the penalties upon the decision of the principal case, out of which the condemnations were issued. Next he is to order the lodging of the documents (muniments) by whomever it may concern, and to require their genuineness to be proved on oath; those documents he will examine: the defective ones and those contrary to natural law he will cancel, the sound ones he will keep in force. Once they have been lodged, he is to separate the substance (property) of the Tchórzewskis from the substance of the Kobylańskis and to award it according to the mind of law and justice; and the maternal substance, movable and immovable, whatever it may prove to be, he will divide among the successors, preserving natural law. Further, the remaining claims, from whatever source they arise, and likewise the acts of violence and all the other heads contained in the court terms and expressed in the mutual protestations – on the basis of the inquisitions carried out – he will settle, mitigate and finally decide, leaving nothing untouched that concerns the above circumstances. To the decision of that magnificent (Magn.) superarbiter together with the Lords Arbiters both parties undertake to submit and hereby so inscribe themselves. Should they oppose the order here inscribed – they declare that they fall under the penalty of banishment, to be adjudged forthwith by the magnificent (Magn.) superarbiter and there and then, at that same term, proclaimed, and they submit themselves entirely to his authority, notwithstanding the withdrawal of one of the Lords Arbiters brought in by the party opposing; promising and inscribing that whatever shall be decided by the said magnificent (Magn.) superarbiter together with the Lords Arbiters they will hold valid, firm and lasting.

Before the subdelegate, the well-born (Gen.) Paweł Domaszowski. The magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, on the one side, and the nobles (Nob.) Jan and Felicjana née Karwowska Krasuski, husband and wife, on the other side, being of sound mind and body, deposed – each of them in their own interest, and the wife with the assistance of her husband – that a certain settlement (komplanacja), concluded between them concerning certain matters and claims, written under the date of 3 January of the year 1743, signed by the hands of the deponents and secured by the securities and the penalty contained in that settlement – they confirm in all its parts (they strengthen and confirm it). And this under the penalty and the securities contained in that contract and the forum of the present office. And immediately afterwards the above-named nobles (Nob.) Krasuski, husband and wife, being of sound mind and body, deposed – each in their own interest, and the wife in particular with the assistance of her husband – that they give a quittance to that magnificent (Magn.) Jezierski, clerk of the Łuków castle court, for the sum of one hundred and eight Polish złoty and for a second sum of eight złoty, and also for one korzec of winter rye, expressed in that settlement; and from the estate under suit and from the sum awarded to them under the settlement they withdraw, with the full transfer of the right to the person of the magnificent (Magn.) party quitted, and they put him into actual possession – in accordance with the settlement inscribed above – (they release the estate to him).

Before the subdelegate, the well-born (Gen.) Jakub Świeżawski. The noble (Nob.) Zofia Izdebska, widow left by the late noble (Nob.) Kazimierz Nurzyński called Żywiec, being of sound mind and body, deposed that to the magnificent (Magn.) Jan a Gołąbki Jezierski, sword-bearer of Liw, clerk of the [Łuków] castle court, and to his successors, she mortgages the estate subject to her power, that is three strips of arable, beginning at the pond and running towards the meadows, between the baulks of that same mortgagee on the one side and of the noble (Nob.) Józef Karwowski on the other, lying in the hereditary estate of the village of Karwów, vacant, together with a meadow, with every right, for the sum of twenty-five Polish złoty, from now for three years, until the feast of the Purification of the Blessed Virgin Mary falling in the coming year 1746, and so on. She consented to intromission forthwith and promised warranty. And this under the land-law penalties and the present forum.

Before the subdelegate, the noble (Nob.) Jakub Świeżawski. The noble (Nob.) Antoni Świerczowski called Bogacz, son of the late noble (Nob.) Paweł, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw, clerk of the Łuków castle court, and to his successors, he gives and donates his hereditary estate, that is four strips of arable, beginning at the place called Grzinka [uncertain reading] and running towards the Jelno boundaries [uncertain reading], between the baulks of that same donee on the one side and of the successors of the late noble (Nob.) Józef Świerczowski on the other, lying in the hereditary estate of the village of Nurzyna, with every right; he consented to intromission forthwith and promised warranty. And this under the land-law penalties and the present forum.

Before the subdelegate, the noble (Nob.) Antoni Modrzewski. The nobles (Nob.) Kazimierz and Adam Karwowski, being of sound mind and body, deposed – each in his own interest – that they give a quittance to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw, clerk of the Łuków castle court, and to his successors for the sum of twenty Polish złoty awarded to them, the deponents, by a decree of condescension of the present office issued on the ground of the Karwów estate on the Saturday after the feast of St Luke the Evangelist in the Year of Our Lord 1731 and entered in the present records on the Saturday on the eve of the feast of the Three Kings in the year 1732 by way of oblation – and this because it has now been sufficiently and fully received from the hands of the magnificent (Magn.) Jezierski, clerk of the Łuków castle court. Further, they withdraw from their suit obtained against him for the whole of the debt on account of the above sum, and they step down from the estate delivered to them by delivery (intromission).

Before the noble (Nob.) Józef Stoiński, vicegerent, subdelegated for this act. The noble (Nob.) Zofia née Nurzyńska, joined [in marriage] to the noble (Nob.) Stanisław Dembowski, and now – by reason of her husband's absence – with the assistance of the noble (Nob.) Maciej Nurzyński Bartoszewicz, her uncle german, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw, clerk of the Łuków castle court, she gives and donates her estate, that is one strip of arable, beginning at the Zapłotna road and running towards [a place – uncertain reading], between the baulks of the noble (Nob.) Kazimierz Nurzyński on the one side and the inheritance share Turzerzyzna [uncertain reading] on the other, lying in the hereditary estate of the village of Nurzyna, with every right; she consented to intromission forthwith and promised warranty, under the land-law penalties and the present forum.

Before the subdelegate, the well-born (Gen.) Jakub Świeżawski. The noble (Nob.) Jadwiga née Sulej, widow left by the late noble (Nob.) Aleksander Nurzyński, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw, clerk of the Łuków castle court, she mortgages the estate subject to her power, namely one strip [of arable], beginning at the Zapłotna road and running towards Ostłogi [uncertain reading], between the baulks of that same magnificent (Magn.) mortgagee on the one side and of the noble (Nob.) Paweł Nurzyński Tomczyk on the other, lying in the hereditary estate of the village of Nurzyna, vacant, with every right, for the sum of eighteen Polish złoty, from now for three years, until the feast of the Purification of the Blessed Virgin Mary falling in the coming year 1746, and so on. She consented to intromission forthwith and promised warranty. And this under a like penalty of eighteen Polish złoty and the present forum.

Before the subdelegate, the noble (Nob.) Jakub Świeżawski. The noble (Nob.) Zofia née Celińska, by her first marriage the wife of the late noble (Nob.) Paweł Nurzyński Kaliś, and thereafter, by marriage, the wife of the noble (Nob.) Wojciech Nurzyński Tomczyk – of whom it is not known where he dwells or whether he is alive – with the assistance of the noble (Nob.) Paweł Nurzyński, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw, clerk of the Łuków castle court, and to his successors, she mortgages the estate subject to her rights, that is one strip of arable, beginning at the Zapłotna road and running towards the Ostłogi, between the baulks of that same magnificent (Magn.) party taking the mortgage on both sides, lying in the hereditary estate of the village of Nurzyna, waste, with every right, for the sum of eight Polish złoty, from now for three years, until the feast of the Purification of the Blessed Virgin Mary falling in the coming year 1746, and so on. She consented to intromission forthwith and promised warranty; and this under a like penalty of eight Polish złoty and the present forum.

Before the same subdelegate. The same [Zofia] on the one side, and the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of Liw, clerk of the Łuków castle court, on the other side, being of sound mind and body, deposed that they give one another a quittance mutually and reciprocally. Namely: [Jezierski] gives a quittance to the nobles (Nob.) Wojciech Nurzyński and Zofia née Celińska, husband and wife, for the sum of fifty Polish złoty – originally inscribed by those spouses to the noble (Nob.) Jakub Dembowski before the present records on the Friday, the vigil of the feast of St Leonard the Confessor in the Year of Our Lord 1736, by way of a simple debt, and thereafter ceded by that same Jakub Dembowski to him, the deponent, before those same records on the Monday after the day of St Stanislaus [in the Rogation days] in the Year of Our Lord 1737 – and now paid out by those same Nurzyński. And the noble (Nob.) Zofia née Celińska Nurzyńska gives a quittance to the magnificent (Magn.) Jezierski for the sum of twenty Polish złoty, inscribed to her, the deponent, at the time when she was in the state of widowhood, before the present records, and now received from the hands of that magnificent (Magn.) Jezierski – as the perpetual acquirer of the inheritance share [the name – uncertain reading]. Those inscriptions both parties cancel.

The well-born (Gen.) Józef Jezierski, vicegerent of Łuków, being of sound mind and body, deposed that in his own name and in the name of the magnificent (Magn.) Krzysztof Jezierski, starosta [the name – uncertain reading], his father, for whose ratification he stands surety, he gives a quittance to the magnificent (Magn.) Antoni Rozwadowski, standard-bearer of Łuków [the title – uncertain reading], for the sum of four hundred and thirty-nine Polish złoty and fifteen groszy – adjudged to the deponent's father by a decree of the present office, in the terms for complaints (in the courts of the office's suits), on the Monday after Laetare Sunday in Lent of the past year 1742, issued between the deponent's father and the party quitted – and likewise for the penalty of three Polish marks adjudged there by that same decree; and this because they have now been paid out by the party quitted. He also gives him a quittance for the suit and action over that sum brought before the present office by the deponent's father, and for all and each of the claims arising up to this day, by reason of the satisfaction rendered; the protestations, the relations, all the decrees and the whole process he cancels.

Before the well-born (Gen.) Franciszek Niewęgłowski, subdelegated for this act. The magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, possessor by privilege of the estate of His Royal Majesty Strzyżów, being of sound mind and body, deposed that in his own name and in the name of the magnificent (Magn.) Franciszek Jezierski, hunter of Drohiczyn [the reading of the title uncertain], possessor of those estates, his father, as also of the subjects Jan Kowal and Grzegorz Miszczuk – his own subjects from those estates, for whom he stands surety – he gives a quittance to the noble (Nob.) Krzysztof Świderski called Damieński and to his successors for the suit and official action brought and lodged with the present office by the deponent's father against the party now quitted on account of the burning of the [buildings of the] subjects of one village, and likewise for the decrees, their enforcement clauses, the condemnations, the executions carried out upon them through the records and the delivery (intromission) itself which followed – and this by reason of the sufficient satisfaction rendered; the protestations, the condemnations and the whole process he cancels.

The same magnificent (Magn.) [Jezierski] deposed before that same subdelegate that, amending all the defects of his withdrawal made with the manifestation, done forthwith and in fact, and seeing that the substance (the property) is burdened with many charges and by no means suffices to satisfy all the creditors, he withdraws officially from the execution – which he would have to renew or continue with himself – because upon those inheritance shares, as the matter stands, in the suit of the magnificent (Magn.) Michał Karwowski, [an officer] of the Mielnik castle court [uncertain reading], there is not for him, as the party acting, a sufficient pledge against the contracting parties out of his rights and cessions, which have the character of an obligatory possession. He declares at the same time that at any hour he is ready to submit to redemption and to render an accounting of the debt due to him from the moment of the act of manifestation together with the withdrawal.

The same magnificent (Magn.) [Jezierski] deposed that he gives a quittance to the noble (Nob.) Antoni Świerczowski for the protestation made against him before the present records on the Monday, the vigil of the feast of the Assumption of the Blessed Virgin Mary, on account of the dishonest taking (interception) of grain, and for the relation entered in that matter – having accepted satisfaction; the protestation and the relation he cancels.

Before the subdelegate, the well-born (Gen.) Paweł Domaszowski, vicegerent of Łuków. The noble (Nob.) Łukasz Nurzyński called Kaliś and Agnieszka likewise née Nurzyńska, husband and wife to one another, being of sound mind and body, deposed – each in his and her own interest, and the said wife with the assistance of her husband and of the noble (Nob.) Wojciech Nurzyński, her brother german – that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land [clerk of the Łuków castle court], and to his successors, they give and donate their hereditary estate, that is a homestead of nine strips, beginning at the Zapłotna road and running towards the village road, between the baulks of that same magnificent (Magn.) donee on the one side and of the noble (Nob.) Wojciech Nurzyński on the other, lying in the hereditary estate of the village of Nurzyna, with every right; they consent to intromission and promise warranty. And this under the land-law penalties and the present forum.

And immediately thereafter that same deponent, the noble (Nob.) Łukasz Nurzyński, deposed that to the above-named noble (Nob.) Agnieszka, likewise Nurzyńska, his lawful wife, and to her successors, he is bound and obliged for the sum of fifty-two Polish złoty – taken up from the hands of the magnificent (Magn.) Jezierski, clerk of the Łuków castle court, on account of the price for the estates described above – by way of a certain, true, just, liquid and simple debt; that sum he inscribes and secures upon all his hereditary estates, and he undertakes to pay that sum on the first demand of his wife and to lodge it with the present records. And this under a penalty of fifty-two Polish złoty and the present forum.

The well-born (Gen.) Karol and Stanisław, sons of the late well-born (Gen.) Wojciech Radzikowski, brothers german to one another, in their own name and in the name of the well-born (Gen.) Franciszka Radzikowska, a maiden, for whose ratification they stand surety, on the one side; and Ludwik and Józef, brothers german to one another, sons of the late well-born (Gen.) Jakub Radzikowski, in their own name and in the name of the well-born (Gen.) Ignacy, Julian, Katarzyna – wife of the well-born (Gen.) Grzegorz Tarczewski – and also Franciszka, Agnieszka and Barbara, unmarried maidens, their brothers and sisters german, for whose ratification they stand surety, on the other side – the Radzikowski, cousins german to one another on the father's side, grandsons of the late well-born (Gen.) Piotr Kazimierz Radzikowski, regent of the Łuków castle court records, and Joanna née Głuchowska, husband and wife – being of sound mind and body, deposed that for the settlement and final adjudication of the suit and action concerning the estates left after the death of the said grandparents and laid waste during the possession of the well-born (Gen.) Jakub Radzikowski, uncle and father – on account of the flight of the subjects, the taking of the profits and the turning of those estates to his own advantage; likewise as regards the inheritance share falling to the well-born (Gen.) Wojciech Radzikowski; and against the same and the well-born (Gen.) Jakub Radzikowski – for the seizure and mortgaging of the manorial and dwelling buildings, their devastation and the allowing of them to fall into ruin, and for the wrongs and damages arising therefrom – they choose and appoint as arbiter and highest judge (umpire, superarbiter) the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court. He is to come down to the estates of the village of Radzików Wielki on the 8th day of April of the present year 1743, together with the Gentlemen Arbiters – two named by each side – having full liberty and absolute power: to make a division of the estates between the litigating parties, to pronounce upon the seizure of the estates and to enjoin [their return] upon whomever it is due; to examine and determine the hereditary rights; to enjoin the production of the documents (muniments) by him whom it concerns; to liquidate the sums taken by either party or by its predecessors or successors, and to lay the charge of them upon him whom it concerns; to enjoin repair and to prevent further destruction; to examine the lawfulness of the claims to the land and to moderate the parties; and finally – should it be needful – to conduct inquisitions, to issue interrogatories for the parties, to adjudge them and to ordain and determine such other things as the matter requires. The parties shall be bound to submit to the decision of the magnificent (Magn.) Umpire and of the Gentlemen Arbiters, and to that they bind themselves – under the land-law penalties and the forum of the present office.

Before the subdelegate, the magnificent (Magn.) Adam Rudzieński, deputy cup-bearer of the Stężyca land. The noble (Nob.) Kazimierz Nurzyński, son of the noble (Nob.) Antoni called Kalisz, being of sound mind and body, deposed that in his own name and in the name of the nobles (Nob.) Franciszek and Andrzej Nurzyński, his brothers under age, for whom he stands surety, to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, and to his successors, he gives and donates his hereditary estate, that is: 1) in the first field, below Suleje [uncertain reading] – seven strips of arable, beginning at the Dembów boundary and running towards the place called Wyszno (already, for that matter, under mortgage to the magnificent (Magn.) donee), between the baulks of the magnificent (Magn.) donee on both sides; 2) in that same field – three strips of arable, beginning at that same Dembów boundary and running towards the place called Wielka, between the baulks of the magnificent (Magn.) donee on the one side and of the noble (Nob.) Anna née Nurzyńska Dembowska, the deponent's aunt, on the other; 3) in the second field called Średnie – four strips of arable, beginning at the Zapłotnia road and running towards the place called Zarębuby [uncertain reading], in a greater breadth however, between the baulks of the magnificent (Magn.) donee on the one side and of the deponent's aunt as above on the other; 4) in the third field, below Świercze – four strips of arable, beginning at the Zapłotnia road and running towards Brzeźnice, between the baulks of the deponent's aunt as above on the one side and of the noble (Nob.) Łukasz Nurzyński on the other – lying in the hereditary estate of the village of Nurzyna, with every right; he consented to intromission forthwith and promised warranty. And this under the land-law penalties and the present forum.

Before the subdelegate, the well-born (Gen.) Michał Kossowski. The noble (Nob.) Bartłomiej Dembowski, son of the late noble (Nob.) Wawrzyniec called Jakusz, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, and to his successors, he cedes, with every right, the sum of twenty-six Polish złoty – inscribed to him, the deponent, by the noble (Nob.) Kazimierz Nurzyński by way of mortgage upon certain estates lying in the hereditary estate of the village of Nurzyna, before the present records on the Monday after the feast of the Nativity of St John the Baptist in the Year of Our Lord 1741, and now received from the hands of the present cessionary; he consents to intromission forthwith and promises warranty from his own side and person. And this under a penalty of twenty-six Polish złoty and the present forum.

The noble (Nob.) Teresa Nurzyńska, daughter of the late noble (Nob.) Maciej Nurzyński called Kalisz, begotten of the late noble (Nob.) Barbara Stocka, and wife of the noble (Nob.) Łukasz Świerczowski, with the assistance of her husband, being of sound mind and body, deposed that on account of the dowry and the due trousseau out of the paternal and maternal estates sufficient satisfaction was rendered to her through the hands of the magnificent (Magn.) Jan Franciszek Jezierski, clerk of the Łuków castle court, by virtue of the donation of certain inheritance shares acquired under the act of this day from the noble (Nob.) Kazimierz Nurzyński. On account of that satisfaction she gives a quittance to the nobles (Nob.) Kazimierz, Franciszek and Andrzej Nurzyński, brothers german, sons of the late noble (Nob.) Antoni Nurzyński, her brother german, and she renounces and abdicates those estates.

Before the subdelegate, the well-born (Gen.) Wojciech Radzikowski, vicegerent of Łuków. The nobles (Nob.) Krzysztof and Sebastian Celiński, being of sound mind and body, deposed that a certain hand-written bond, given under the date at Nurzyna on the 5th day of March of the present year 1743 to the person of the magnificent (Magn.) Jan Jezierski, clerk of the Łuków castle court, running to the sum of seven hundred and twenty Polish złoty, written down and issued by themselves, secured by a penalty of the like sum – they confirm and approve in everything. And this under a penalty of seven hundred and twenty Polish złoty and the forum of any place whatsoever.

The magnificent (Magn.) Michał Wyszyński, hunter of Sanok, son of the late magnificent (Magn.) Jan Wyszyński, deputy pantler of the Bielsk land, being of sound mind and body, deposed that to the magnificent (Magn.) Hiacynt Jezierski and to his successors he gives, donates and resigns in perpetuity his hereditary subjects, the industrious (Labor.) Tomasz Tkacz and Błażej Kowal, brothers german to one another, of the magnificent (Magn.) in the village of Magna Gora, lying in the district of Garwolin and in the Warsaw land, who fled from that village altogether and were found in the estates of that same magnificent (Magn.) donee – together with all the property and appurtenances of those subjects; giving and granting to that same magnificent (Magn.) donee the power to hold them, to possess them and to settle them in his own hereditary estates. Moreover that same magnificent (Magn.) deponent undertakes a general warranty against all hindrances and inscribes it upon all his estates, appointing the ubiquitous forum for answering.

Before the subdelegate, the well-born (Gen.) Paweł Domaszowski, vicegerent of Łuków. The noble (Nob.) Agnieszka Celińska, daughter of the late noble (Nob.) Jan Celiński called Jakubowicz, wife of the noble (Nob.) Maciej Sulej, with the assistance of her husband, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, and to his successors, she gives and donates with every right her hereditary estate, that is her whole and entire inheritance share – in the plot, the arable, the fields, meadows, woods, forests, groves, rivers and streams and in all the other appurtenances and appendages of that inheritance share – lying in the hereditary estate of the village of Nurzyna, both the part that is free and that which remains mortgaged to any persons whatsoever, and which the present donee shall be bound to redeem; she consents to intromission forthwith and undertakes warranty. And this under the land-law penalties and the forum of the present office.

The noble (Nob.) Maciej Sulej, son of the late noble (Nob.) Paweł called Pietrzyk, being of sound mind and body, deposed that to the noble (Nob.) Agnieszka Celińska, daughter of the noble (Nob.) Jan Celiński called Jakubowicz, his lawful wife, and to her successors, he is bound and obliged for the sum of thirty-two Polish złoty – received for the estate resigned by her herself this day by perpetual right to the magnificent (Magn.) Jan Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, and brought into his own estate – on account of a certain, true, just, liquid and simple debt. That sum he inscribes and secures upon all his estates, and he undertakes to pay that sum on the first demand of his wife and to lodge it with the present records. And this under a like penalty of thirty-two Polish złoty and the present forum.

The well-born (Gen.) Tomasz Jezierski, son of the late well-born (Gen.) Piotr Jezierski, being of sound mind and body, deposed that to the well-born (Gen.) Tomasz Szaniawski, son of the late magnificent (Magn.) Stanisław Szaniawski, tribune of Lublin, and to his successors, he mortgages the estates subject to his right, that is whole and entire inheritance shares – in the plots, the arable, the fields, meadows, woods, forests, lakes, rivers and streams, and likewise together with the subjects belonging to them and with their dues customary of old, and with all the other appurtenances and appendages of those inheritance shares – lying in the hereditary estate of the villages of Belna and Wierzchowiny, of which only two places are sown with winter corn and the rest is waste, with every right, for the sum of seventy-two Polish złoty, from now until redemption. He consented to intromission forthwith and promised warranty. And this under a penalty of seventy Polish złoty and the present forum.

Heading: „The fifth protocol of inscriptions”. Date: the Saturday after Laetare Sunday in Lent in the Year of Our Lord 1743.

The nobles (Nob.) Marcin Wierzchowski and Teresa née Karwowska, spouses of one another – the wife with the assistance of her husband – on the one side, and Jan Tchórzewski, in his own name and in the name of the noble (Nob.) Franciszka née Jezierska, his wife, and of Stanisław Tchórzewski, his brother german, for whose ratification he stands surety, on the other side, being of sound mind and body, deposed that mutually and reciprocally they give a quittance to one another and to their successors for the protestations made against one another before the present records in the year 1734, on account of attempted acts of violence, defamation, injury to honour and the infliction of wounds upon the noble (Nob.) Marcin Wierzchowski in a mutual affray, and likewise of the maiming of a finger; for the inspection of wounds noted there and for the relations entered in that same year; and finally for all and each of the claims which they had against one another on that account – and this by reason of the amicable settlement concluded between them and of the satisfaction rendered. The protestations together with the inspections of wounds and the relations they cancel.

Before the present castle court records of Łuków, having appeared in person, the magnificent (Magn.) Antoni Domaszowski, cup-bearer of Owrucz, being of sound mind and body, deposed that to the well-born (Gen.) Józef Jezierski, vicegerent of the Łuków castle court, son of the magnificent (Magn.) Krzysztof Jezierski, starosta of Grodziec, sword-bearer of the Łuków land — for the sum of four thousand five hundred Polish złoty, inscribed by the said magnificent (Magn.) Jezierski, starosta of Grodziec, the father of the party now quitted, by way of a simple debt upon all his estates before the present records on the Tuesday before the feast of St Peter in Chains in the Year of Our Lord 1736, together with the interest secured for payment — both for the original sum and for the interest accrued upon that sum up to this day, and now paid to him, the deponent, in fact and effectually by the noble (Nob.) Jezierski who gives the quittance, as the person who, by the disposition of the said magnificent (Magn.) Krzysztof Jezierski, starosta of Grodziec, his father, is heir of the whole substance and the actual possessor of all the estates, and takes upon himself every burden of his — and likewise for the suit and action brought and lodged with the present office on account of that sum, for the relation entered and for the decree of dilation of muniments issued in that matter, and for everything that hangs upon that suit in the registers — he gives a quittance, releases and discharges for ever. And the present inscription mentioned above, together with its conditions, and the decree of dilation of muniments, as also the entries in the registers of the office of suits hanging upon it, he cancels and declares void.

Before the subdelegate, the well-born (Gen.) Michał Kossowski. — Having appeared in person, the noble (Nob.) Szymon Wierzejski, son of the late noble (Nob.) Bartłomiej, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Franciszek Jezierski, clerk of the Łuków castle court, and to his successors, his hereditary estate, that is his whole and entire inheritance shares, in the plots, the arable, the fields, meadows, woods, forests, groves, rivers, streams and the other appurtenances and appendages of those estates, together with the buildings and all the structures, lying and situated in the hereditary estate of the village of Wierzejki, sown with winter grain, with everything — for the sum of one hundred and twenty-six Polish złoty in Hungarian red złoty, from now until the day of the feast of the Most Holy and Undivided Trinity falling in the current year 1743, he mortgages and obligates, and thereafter from year to year, and he puts them from now into his possession, renouncing every right of his own, and this under a penalty of one hundred and twenty-six Polish złoty, before the forum of the present office.

That same [Father Michał Koszelnicki], with the assistance of the same person as above, in his own name and in the name of the whole of the said convent, being of sound mind and body, deposed that to the industrious (Labor.) Franciszek Kamiński, of Trzembowlice [uncertain reading], and to his successors — for the suit and official action brought before the present office concerning the sum of two hundred and twenty Polish złoty, inscribed in the first place and at its source by the late Kaznowski to the magnificent (Magn.) Jan Jezierski, land judge of Łuków, before the present records, and afterwards ceded by that same magnificent (Magn.) Jezierski to the said convent of Łuków on the Saturday on the eve of the feast of the holy Apostles Peter and Paul in the Year of Our Lord 1670, and already taken up and satisfied by that same convent by means of a quittance made before the present records on the Monday after Exaudi Sunday in the Year of Our Lord 1708 — the suit having been begun and lodged after that sum had been satisfied — and likewise for the condemnation obtained in that respect at certain terms, that is the courts of suits of the present office, on the Monday after the feast of the Assumption of the Most Glorious Virgin Mary in the past year 1742 — he gives a quittance, and that condemnation he cancels in its entirety.

Before the subdelegate, the well-born (Gen.) Paweł Domaszowski. – Having appeared in person, the nobles (Nob.) Marianna née Mleczko, widow left by the late well-born (Gen.) Jan Celiński and, after that husband, mistress of her rights, and Józef, the son, Celiński, being of sound mind and body, deposed that in their own name and in the name of their successors, and likewise of the noble (Nob.) Franciszek Celiński, for whose ratification they stand surety, to the magnificent (Magn.) Jan Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, and to his successors, they give and donate their estates – the mother those that are subject to her rights, and the son his hereditary ones – that is eight strips of plot land, beginning at the village road and running towards the Zapłotnia road, between the baulks of the noble (Nob.) Paweł Celiński called Drozd on the one side and of the noble (Nob.) Adam Celiński on the other, lying and situated in the hereditary estate of the village of Celiny, with everything. Intromission forthwith, of civil right; and this under the land-law penalties, before the forum of the present office.

Before the subdelegate named above, having appeared in person, the magnificent (Magn.) Jan Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, on the one side, and the nobles (Nob.) Marianna née Mleczko, widow left by the late well-born (Gen.) Jan Celiński, the mother, and Józef, the son, Celiński, on the other side, being of sound mind and body, deposed that a certain contract concerning the resignation of a certain plot, drawn up between them, the deponents, on this day, signed in their own hands and secured by the land-law penalties, they approve in everything, and they strengthen and approve it; and this under the land-law penalties, before the forum of the present office.

The magnificent (Magn.) Adam Łaski, deputy voivode of Łuków, being of sound mind and body, deposed that a certain hand-written bond, running in favour of and to the person of the magnificent (Magn.) Antoni Jezierski, vice-starosta of Lublin, issued by him, the deponent himself, here at Łuków on the second day of May of the current year 1743, signed in his own hand and secured by the conditions (ligamenta) contained in that same bond – he approves in everything, and he strengthens and approves it; and this under the conditions contained in it, before the forum of the present office.

Having appeared in person before the present castle court records of Łuków, the noble (Nob.) Jan Karwowski called Mścich, being of sound mind and body, deposed that he gives a quittance to the magnificent (Magn.) Jan Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, his lord, and likewise to Maciej and Anna Oziębło, subjects of the estate of Karwów, subject to the present possession of that same magnificent (Magn.) Jezierski, as also to the well-born (Gen.) Melchior Karwowski – for the suit and official action brought and lodged with the present office on account of the acts of violence inflicted upon him, the deponent, by those same subjects, and lastly on account of the failure of the said Melchior Karwowski, during his possession, to render justice as regards his subjects – and likewise for the decrees handed down in that case before, and finally for the decree issued by the present office between the deponent and the party quitted on the Monday after the feast of the Assumption of the Blessed Virgin Mary in the Year of Our Lord 1742 – as also for the marks both for incontinence (incontinentia) and for the acts of violence and the wounds, and moreover for the penalties extended to the subjects and in fact carried out, and lastly for the tower confinement enjoined by that same decree upon the said well-born (Gen.) Melchior Karwowski – after the satisfaction received and the marks actually paid; and the decree and the whole process he cancels.

Before the subdelegate, the well-born (Gen.) Paweł Domaszowski. – Having appeared in person, the nobles (Nob.) Jadwiga Sulejówna, widow left by the late noble (Nob.) Aleksander Nurzyński, the mother, and Wojciech Nurzyński, the son, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Jezierski, clerk of the Łuków castle court, and to his successors, they give and donate their estates – the mother those that are subject to her rights, and the son his hereditary ones – that is three strips of meadow, between the baulks of the successors of the late noble (Nob.) Kazimierz Nurzyński on the one side and of the successors of the late noble (Nob.) Tomasz Nurzyński on the other, lying and situated in the hereditary estate of the village of Nurzyna, with everything. Intromission forthwith, by the general court; and this under the land-law penalties, appointing the forum of the present office for answering.

Before the subdelegate named above. – Having appeared in person, the noble (Nob.) Agnieszka née Nurzyńska of the Tomczyk line, daughter of the late noble (Nob.) Aleksander Nurzyński and wife of the noble (Nob.) Łukasz Nurzyński called Kalisz, with the assistance of that husband of hers and of the noble (Nob.) Wojciech Nurzyński called Tomczyk, her brother german, being of sound mind and body, deposed that to the magnificent (Magn.) Before that same subdelegate named above. – Having appeared in person, the noble (Nob.) Łukasz Nurzyński, son of the late noble (Nob.) Paweł, called Kalisz, being of sound mind and body, deposed that he gives a quittance to the magnificent (Magn.) Jan Jezierski, clerk of Łuków, for a sum of thirty-four Polish złoty, being the price of the estates resigned on this day, paid by that same magnificent (Magn.) party quitted and taken up by the deponent himself in favour of his wife; and he provides security for that sum upon his estates.

Having appeared in person before the present castle court records of Łuków, the magnificent (Magn.) Franciszek of Nowosielec and Zakrze Nowosielski, colonel and cavalry captain of His Royal Majesty and of the Commonwealth, being of sound mind and body, deposed that to the magnificent (Magn.) Franciszek Jezierski, standard-bearer of the Łuków land, and to his successors, the estates resigned to him in perpetuity by that same magnificent (Magn.) standard-bearer before the present records on the Tuesday after the feast of the Visitation of the Blessed Virgin Mary in the Year of Our Lord 1729, that is one plot with the buildings and all the edifices standing upon it, lying and situated here on the ground of His Royal Majesty's town of Łuków, with everything – he gives and donates, or rather gives back (redonat). Intromission forthwith, of civil right; and this under the land-law penalties, before the forum of the present office.

The well-born (Gen.) Jan Jezierski, son of the late well-born (Gen.) Kazimierz Jezierski begotten of the late well-born (Gen.) Apolonia née Dziewiecka, being of sound mind and body, deposed that to the well-born (Gen.) Grzegorz and Marianna Stefanowski, son and daughter of the well-born (Gen.) Aleksander Stefanowski begotten of the late well-born (Gen.) Anna née Jezierska, and to their successors, the sum of three hundred Polish złoty – secured for payment to the well-born (Gen.) father of the deponent by a pre-nuptial contract (a marriage contract, intercyza) drawn up under the date of 23 January in the Year of Our Lord 1691 between the well-born (Gen.) Kazimierz and Barbara née Stobocka [uncertain reading] Dziewiecki, husband and wife, and the above-mentioned late parents of the deponent –

together with the whole and entire right of his serving to the above, he makes over and withdraws from it, giving them every [power] to vindicate that sum, to take up what is vindicated, to give a quittance for what is taken up and to act at law concerning it at their pleasure; [the marriage contract] was lodged with the Lublin castle court by way of oblation in the year 1692.

Tomasz Jezierski, in his own name and in the name of his brother, by means of an acknowledgement of the original inscriptions, before the present records on the Saturday after Judica Sunday in Lent in the Year of Our Lord 1740 [9 April 1740];

the second – of five hundred Polish złoty, [inscribed] by the magnificent (Magn.) Jan Grodzicki by that same act indicated above;

the third – of one hundred Polish złoty, [inscribed] by that same magnificent (Magn.) Jan Grodzicki, added to the above-named sum of five hundred złoty, before the present records on the Friday after Exaudi Sunday of that same year 1740 [3 June 1740];

and the fourth – of twenty-seven Polish złoty, [inscribed] by the often-mentioned magnificent (Magn.) Jan Grodzicki, on the Wednesday after Laetare Sunday in Lent of the current year 1743 [27 March 1743] before those same records –

both by way of obligation and by way of addition, inscribed and acquired upon the estates in the hereditary village of Bełna, together with all the conditions of those inscriptions; and this, in satisfaction of the contract officially confirmed today, he cedes and transfers all [the rights]; he consents to intromission from now on for the future and submits, both in the matter and in his own person, to the court, and this under a like penalty of the sum of eight hundred and seventy-seven Polish złoty in all and under the jurisdiction of the present office.

The magnificent (Magn.) [Jan Franciszek Jezierski] on the one side, and the noble (Nob.) Bartłomiej Dembowski, in his own name and in the name of the noble (Nob.) Anna née Nurzyńska, his wife, for whose ratification he stands surety, on the other side, being of sound mind and body, deposed that, giving one another land for land and inheritance for inheritance, they make between themselves a perpetual exchange, namely:

the magnificent (Magn.) Jezierski [gives] to the noble (Nob.) Dembowskis, husband and wife, and especially to the wife, one strip of arable with half of a second, beginning at the road in the place called [the name – uncertain reading] and running towards the meadows, between the baulks of the noble (Nob.) Adam Dembowski on the one side and of the successors of the noble (Nob.) Kazimierz Nurzyński on the other; likewise one strip of arable, beginning at the village road and running towards the rampart, between the baulks of the noble (Nob.) and the noble (Nob.) Bartłomiej Dembowski [gives] to that same magnificent (Magn.) Jezierski one strip of arable with half of a second, of the length of the first strip, between both baulks of the magnificent (Magn.) party exchanging; likewise in another place one strip of arable, beginning at the road [the name – uncertain reading] and running towards Bielki, between the baulks of the magnificent (Magn.) donee on the one side and of the noble (Nob.) Franciszek a Gołąbki Jezierski, standard-bearer of the Łuków land, being of sound mind and body, deposed that to the venerable (Ven.) and devout (Devot.) father in Christ Józef Szyndlarski, guardian of the Łuków convent of the Order of Friars Minor of St Francis Observant, and to the whole venerable (Ven.) convent itself and to the guardians for the time being, the sum of two thousand Polish złoty –

out of the original sum of seven thousand Polish złoty from the estate of Stanin with its appurtenances, according to the tenor of the disposition […], adjudged by a decree of the Lublin Tribunal on the Tuesday before the feast of the Transfiguration of Our Lord in the year 1739 [4 August 1739] and ordered to be paid into the hands of his magnificent (Magn.) father, and afterwards raised by him by virtue of a quittance on the Thursday before the feast of St Thomas the Apostle of the year 1740 before the present records; and finally in fact raised over and above the hand-written quittances and the sums previously due from the deponent himself –

that is to say, that same sum of two thousand Polish złoty, remaining out of the above-named original sum and appointed by the superiors of those fathers to be placed out, by way of redemption, otherwise „na wyderkaf”, he is bound and obliged; which sum he inscribes and places upon his hereditary estate of Rogale; and a rent of seven per hundred yearly from that sum he undertakes and binds himself, together with his successors, to pay to that same convent; and this under a penalty of a like sum of two thousand Polish złoty together with the rent falling due from it, indicating the court of the present office as the forum for answering.

Piotr Cielemęcki, chamberlain of the Mielnik land, brothers german to one another, as also the well-born (Gen.) Adam Łaski, deputy voivode of Łuków, as the third party, being of sound mind and body, deposed that – for the final settling and deciding of the classes of claims, both between themselves the brothers and […] held and arising up to this day –

as the highest arbiter and judge (the umpire) they choose, inscribe, appoint and solemnly […] the magnificent (Magn.) Krzysztof a Gołąbki Jezierski, giving and granting to that same magnificent (Magn.) umpire […] the right to hold a condescension and to establish the jurisdiction.

That same magnificent (Magn.) umpire is to come down to the condescension at the convent of the fathers of the Order of St Francis Observant here at Łuków on the Wednesday after the feast of the Nativity of St John the Baptist [26 June 1743], together with the magnificent (Magn.) arbiters, two appointed by each side.

First of all he shall bind the well-born (Gen.) Adam Łaski, deputy voivode of Łuków, and the magnificent (Magn.) Joanna née Jezierska – by her first marriage the wife of the late magnificent (Magn.) Piotr Cielemęcki, chamberlain of the Mielnik land, and by her second marriage the wife of that same [Łaski] – her husband, to produce the documents, throwing light upon the mass of the Cielemęcki substance; upon that production, preceded above all by an oath taken and confirmed, he shall establish that mass and shall separate from the Cielemęcki substance what passed to the successors by title of the late Joanna née Jezierska Łaska;

next he shall examine the lawfulness of the succession – both after the late […] and after Piotr Cielemęcki, the father, and after the nobles (Nob.) Franciszek and Józef Cielemęcki, brothers german, who died without issue, and after Antoni […]; regulating the rights and actions of the parties, he shall decide all the transactions, shall ascertain to whom what fell, and shall cancel or confirm the claims of the parties – according to equity; from whatever source they arise, he shall judge them according to the degrees of law that shall be required;

finally, in his decision, according to the classes described above, he shall order the setting apart […] of sums of that kind in due proportion both to the parties and to the competing claimants, in […] the making of satisfaction.

As regards the noble (Nob.) deputy voivode of Łuków – on account of the sum of six thousand Polish złoty contracted by the late […] in favour of […] Hiacynt, he shall decide and shall compel to warranty whomsoever it shall fall to, or shall secure him upon the sums concerning him, so far as they suffice; and should the warranty upon the sums named above and upon others prove insufficient – he shall reserve to himself the indication [of further security].

Promising and inscribing themselves that whatever shall be decided and adjudged by the said magnificent (Magn.) umpire together with the magnificent (Magn.) arbiters, they shall hold as valid and agreeable; and this under the land-law damages and under the jurisdiction of the present office.

The magnificent (Magn.) Krzysztof Jezierski, starosta of Grodziec, the father, on the one side, and the well-born (Gen.) Józef Jezierski, vicegerent of the Łuków castle court, the son, on the other side, being sound in body and mind, deposed – and each of them deposed in his own interest – that a certain lease contract, concerning the matters and claims expressed in it, concluded between them in the estate of the village of Szczygły Dębniaki on the 26th day of June in the Year of Our Lord 1743, written down and signed in their own hands, secured by a penalty of eight thousand Polish złoty – they confirm in everything (they strengthen and confirm it). And this under a like penalty of eight thousand Polish złoty and under the jurisdiction of the present office.

Hiacynt Jezierski, cup-bearer of Gostynin, on the other side, being of sound mind and body, deposed that a certain lease contract, concerning the movable things and the conditions expressed in that same contract, under the date here at Łuków on the 8th day of July in the Year of Our Lord 1743, written down and drawn up between themselves, signed in their own hands, secured by a penalty of one thousand eight hundred Polish złoty – they confirm in everything (they strengthen and confirm it), together with the paragraph appended to that same contract. And this under a like penalty of one thousand eight hundred Polish złoty and under the jurisdiction of the present office.

Jan Franciszek a Gołąbki Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, being of sound mind and body, deposed that he gives a quittance to the nobles (Nob.) Wojciech and Antoni Izdebski and to their successors – for the sum of thirty [odd] Polish złoty, remaining out of the price for the estate, that is for the inheritance share called Bartosiem Rzepka [uncertain reading], donated by those same parties quitted, and now in fact paid out by them to the deponent – by reason of the sufficient satisfaction rendered to him he gives a quittance, and the donation he approves.

The same magnificent (Magn.) deponent [Jan Franciszek Jezierski], being of sound mind and body, deposed that to the well-born (Gen.) Franciszek Gołaski, comrade of the armoured banner of the magnificent (Magn.) Skarżyński, hunter of the Grand Duchy of Lithuania, and to his successors he gives and donates his hereditary estate, that is six strips of arable, beginning at the river Krzna and running towards the Nurzyna cutting, between the baulks of the magnificent (Magn.) deponent himself on the one side and of the noble (Nob.) Maciej Nurzyński called Krawczaczek on the other, situated and lying in the hereditary village of Suleje Borzymy, with everything. He consented to intromission forthwith and promised warranty, and this under the land-law damages. The court of the present office.

Jan Franciszek Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, and to his successors he gives and donates his acquired estate, that is one strip of arable with half of a second, beginning at the road called Zawalna and running towards the place called Przełazy [uncertain reading], between the baulks of the noble (Nob.) Paweł Nurzyński on the one side and of the noble (Nob.) Wojciech Nurzyński on the other, lying in the hereditary village of Nurzyna, with everything. He consented to intromission forthwith and promised warranty, and this under the land-law damages, for which he appoints the present court.

Andrzej Szaniawski on the one side, and Wojciech and Katarzyna née Jezierska, spouses of one another – she with the assistance of that same husband of hers – on the other side, being of sound mind and body, deposed and acknowledged that mutually and the one to the other, and to their successors, they give a quittance – for the suits and official actions brought and lodged with the present office on account of the committing of acts of violence, the infliction of wounds and other claims; for whatsoever decrees, further for the marks and penalties adjudged by them, for the whole and entire process, as also for all and each of the claims which they had against one another up to this day – by reason of the settlement concluded and of the satisfaction rendered; and the protestations, the relations and whatsoever decrees together with their enforcement clauses they cancel.

The magnificent (Magn.) Jan Jezierski, sword-bearer of the Liw land, clerk of the Łuków castle court, on the one side, and the well-born (Gen.) Jan Zdziarski on the other side, being of sound mind and body, deposed and acknowledged that mutually and reciprocally they give a quittance to one another and to their successors, and namely:

the magnificent (Magn.) Jezierski to the well-born (Gen.) Zdziarski – for the suit and official action brought and lodged with the present office through a term touched upon, likewise for the penalties and marks adjudged by a decree issued in the present office and for the penalty of the tower enjoined by that same decree;

and that same well-born (Gen.) Zdziarski to the magnificent (Magn.) Jezierski, clerk of the Łuków castle court – for a certain manifestation, made against the condemnation and injurious to the unimpaired honour of that same magnificent (Magn.) party quitted, which manifestation he withdraws;

and this by reason of the settlement concluded between them and of the actual payment by the well-born (Gen.) Zdziarski of the marks to the convent of the Bernardine Fathers of Łuków, with the leave of that same magnificent (Magn.) clerk of Łuków; and the decree together with its enforcement clause, and that same manifestation, they cancel.
