Józef Skrzyszewski, deputy vogt of Łuków, and to her successors begotten with that same husband, for the suit and official action brought and lodged with the present office concerning a sum; as also for the decree handed down in that matter in the terms for complaints (the courts of suits) of the present office on the Monday after Misericordia Sunday in the Year of Our Lord 1723, between the deponent and the late well-born (Gen.) Skrzyszewski, deputy vogt of Łuków, the father of the husband of the party now quitted; further, for the manifestation, for the relation, for the condemnation obtained at the peremptory term and for the execution carried out by virtue of it, and for the sum itself of fifty-two Polish złoty adjudged by that same decree – and this because that sum was for the greater part in fact paid by the late well-born (Gen.) Józef Skrzyszewski, the husband, and the remainder by the party quitted herself. All the decrees, the protestations and the whole process she cancels.

Before the present castle court records of Łuków, having appeared in person, the well-born (Gen.) Tomasz Spyta Skrzyszewski, son of the late noble (Nob.) Jan Borzechowski, tribune of Bracław, and to his lawful successors, he is bound and obliged for the sum of one hundred and twenty-four Polish złoty, by way of a certain, true, just, liquid and simple debt. That sum he inscribes and secures upon all and each of his hereditary and mortgaged estates, both those held and those which he shall hold, undertaking and binding himself to pay it from now, on the Monday after the feast of the Nativity of St John the Baptist falling in the current year 1743, to that same magnificent (Magn.) creditor of his, and to lodge it with the present records, and this under a penalty of the sum of one hundred and twenty-four Polish złoty, before the forum of the present office, with the obligation of answering.

and the nobles (Nob.) Władysław Kisieliński and Kacper Skrzyszewski called Skorupka on the other side, being of sound mind and body, deposed that they – for the composing and the final determination of the suit and action over the hastening of death (acceleratio fatorum) in the person of the late noble (Nob.) Jan Przygocki, husband of the noble (Nob.) Krystyna née Domańska of the first bed, brought against the nobles (Nob.) Skrzyszewski and Kisieliński before the Łuków castle court office – choose as supreme judge and umpire (superarbiter) the magnificent (Magn.) Paweł Stoiński, deputy cup-bearer of the Łuków land and vice-starosta of the Łuków castle court, appointing him for this day at Łuków the place of the meeting, together with the arbiters whom each of the parties is to set up on its own side; that suit, according to the terms issued and the protestations, he is to carry through in full and finally to judge, and what he shall hold to be right and just, to that the parties are bound to be obedient and by that to abide – and this under a penalty of two hundred Polish marks, for which they appoint the forum of the present office.

notes and marginalia The gravest case in this part of the register: „acceleratio fatorum” is the formula denoting the causing of someone's death. The parties submit it to an arbitration court with an umpire in the person of the vice-starosta of Łuków, Paweł Stoiński, under the very high penalty of 200 marks. A rarely noted procedural circumstance: the wife acts with the assistance of two kinsmen, because her husband „leży w łóżku w chorobie”. The PTG tag for scan 167 gives the deponent as „Krystyna Domańska pv Przygodzka sv Rzymowska” – the manuscript writes the surname of the first husband „Przygocki”; the discrepancy has been noted. The remaining persons agree with the tags.

notes and marginalia The most detailed description of scattered lands in this part of the edition: seven separate pieces of arable, together 35 strips, with an indication which of them are sown („inseminati”, „semine hyemali”) and which are vacant. The mortgage was constituted in favour of three stepchildren: the children of Krystyna née Domańska by her first marriage with Jan Przygodzki. A discrepancy with the PTG tags: the tag for scan 57-024 gives „Franciszka Przygodzka” (a feminine form), whereas the manuscript has „N. Francisco … filio et filiabus” – the son and the daughters, which grammatically excludes the feminine form; the reading of the manuscript has been adopted and the discrepancy noted instead of being smoothed away. The reading of the manuscript is confirmed by the PTG tags for scans 57-025 and 57-026, where the same person figures as „Franciszek Przygodzki” (a masculine form). The name „Marianna Domańska” at one of the baulks has been read with uncertainty and is not in the tags. The term of redemption: St John the Baptist (24 June) 1744, with the clause „de anno ad annum”.

notes and marginalia The gravest case noted so far in the year 1744: „acceleratio fatorum” – the hastening of the death of Jan Przygodzki, husband of Krystyna née Domańska. The judgement was handed down not in the castle court but before an arbitration court at Łuków, and it embraced the penalty of the tower (sessio turrica); it was brought into the castle court records by oblation on 18 December 1743 (the Wednesday before St Thomas the Apostle, 21 December 1743 – the day of the week verified). The settlement of 26 February 1744 closes the matter: the parties give a quittance to one another, and the decree and the penalty of the tower are cancelled. The entry explains at the same time the series of mortgages of that same day (1193, 1194, 1200): the Skrzyszewski and Kisieliński, the doers, gave the children of the slain man land in mortgage by title of compensation.
