Borzechowski

The honest (Hon.) Marianna née Regulska, by her first marriage the wife of the late renowned (Fam.) Jan Dziewiątkowski, and now by her second marriage the wife of the renowned (Fam.) Franciszek Okuł – on account of the absence of her husband, with the assistance of the renowned (Fam.) Michał Dziewiątkowski, her son of the first bed – being of sound mind and body, deposed that she gives a quittance to Joanna née Borzechowska, widow left by the late well-born (Gen.) Józef Skrzyszewski, deputy vogt of Łuków, and to her successors begotten with that same husband, for the suit and official action brought and lodged with the present office concerning a sum; as also for the decree handed down in that matter in the terms for complaints (the courts of suits) of the present office on the Monday after Misericordia Sunday in the Year of Our Lord 1723, between the deponent and the late well-born (Gen.) Skrzyszewski, deputy vogt of Łuków, the father of the husband of the party now quitted; further, for the manifestation, for the relation, for the condemnation obtained at the peremptory term and for the execution carried out by virtue of it, and for the sum itself of fifty-two Polish złoty adjudged by that same decree – and this because that sum was for the greater part in fact paid by the late well-born (Gen.) Józef Skrzyszewski, the husband, and the remainder by the party quitted herself. All the decrees, the protestations and the whole process she cancels.

The noble (Nob.) Andrzej Rozwadowski, son of the late noble (Nob.) Paweł called Tyburcy, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Borzechowski, tribune of Bracław, and to his successors, he gives and donates his hereditary estate – fallen to him after the late noble (Nob.) Marianna née Szczygielska Wilczyńska, the deponent's aunt, who died without issue, and devolved upon him by divine right and natural succession – that is his small inheritance share falling to him out of those estates, in a homestead beginning at the little causeway and running towards the fields called Długie, lying in the hereditary estate of the village of Rozwadów Stary, with every right; he consented to intromission forthwith and promised warranty. And this under the land-law penalties and the present forum.

Before the present castle court records of Łuków, having appeared in person, the well-born (Gen.) Tomasz Spyta Skrzyszewski, son of the late noble (Nob.) Jan Skrzyszewski, being of sound mind and body, deposed that to the magnificent (Magn.) Jan Borzechowski, tribune of Bracław, and to his lawful successors, he is bound and obliged for the sum of one hundred and twenty-four Polish złoty, by way of a certain, true, just, liquid and simple debt. That sum he inscribes and secures upon all and each of his hereditary and mortgaged estates, both those held and those which he shall hold, undertaking and binding himself to pay it from now, on the Monday after the feast of the Nativity of St John the Baptist falling in the current year 1743, to that same magnificent (Magn.) creditor of his, and to lodge it with the present records, and this under a penalty of the sum of one hundred and twenty-four Polish złoty, before the forum of the present office, with the obligation of answering.

Having appeared in person before the present castle court records of Łuków, the magnificent (Magn.) Jan Borzechowski, tribune of the Bracław land, being of sound mind and body, deposed that the noble (Nob.) Zofia née Jastrzębska, the mother, and Tomasz and Antoni Niewęgłowski, and likewise their successors — for the simple penalty of fourteen Polish marks and for the luitum penalty of three Polish marks, adjudged by a decree of the then confederate court, issued on the Saturday after the feast of the Visitation of the Blessed Virgin Mary in the Year of Our Lord 1733, and likewise for the tower confinement (sessio turrica) enjoined by that same decree — the said penalties having been in fact paid — he gives a quittance, releases and perpetually acquits.

The same deposed between themselves that to the magnificent (Magn.) Jan Borzechowski, tribune of Bracław, son of the magnificent (Magn.) Jan Borzechowski likewise, and to his successors, their estates — the father his hereditary estates, and the son those which are subject to the maternal rights — that is six strips of arable, beginning at the Łuków road and running towards the added parcels by Majnety [uncertain reading], between the baulks of the noble (Nob.) Jan Jaroszewski on the one side and of the donee himself on the other; further, one strip of arable with a half, beginning at the Zapłotnia road and running towards the boundaries, or rather towards the ground of the donee himself, between the baulks of the noble (Nob.) Józef Turski on the one side and of the donee himself on the other; further, two parcels of meadow, beginning at the added parcels by Glinianki and running towards the Sobolskie boundaries, between the same baulks — lying and situated in the hereditary estate of the village of Rozwadów, with everything — they give and donate; intromission from now, by civil law, and this under the land-law penalties, before the forum of the present office.

The same deponents on the one side, and the magnificent (Magn.) Jan Borzechowski on the other side, being of sound mind and body, deposed that a certain contract, concluded between them under the act and date at Rozwadów on 30 May of the current year 1743, concerning certain conditions expressed in it, drawn up and written, signed in their own hands and secured by the land-law penalties — they approve in everything, and they strengthen and confirm it, and this under the land-law penalties, before the forum of the present office.

Having appeared in person before the present castle court records of Łuków, the magnificent (Magn.) Jan Borzechowski, tribune of Bracław, on the one side, and the noble (Nob.) Jan Pawłowski on the other side, being of sound mind and body, deposed that, giving one another ground for ground, land for land, hereditary estate for hereditary estate, they make between themselves the following exchange: namely, the magnificent (Magn.) Borzechowski to the noble (Nob.) Jan Pawłowski and to his successors his hereditary estate, that is two parcels of meadow, beginning at the longer meadows and running towards the Sobolskie boundaries, between the baulks of the noble (Nob.) Józef Turski and of Jan Rozwadowski [the byname an uncertain reading] on the other side; and the noble (Nob.) Pawłowski to the magnificent (Magn.) Jan Borzechowski and to his successors, in exchange, likewise his hereditary estate, that is two parcels of meadow, beginning at the added parcels called Glinianki and running towards the Sobolskie boundaries, between the baulks of that same magnificent (Magn.) Borzechowski on the one side and of the nobles (Nob.) Wysokiński on the other — lying and situated in the hereditary estate of the village of Rozwadów, with everything — they give, donate, that is they exchange; intromission from now, by civil law, and this under the land-law penalties, before the forum of the present office.

The magnificent (Magn.) Franciszka née Laskowska, lawful wife of the magnificent (Magn.) Jan Borzechowski, tribune of Bracław, daughter begotten of the late magnificent (Magn.) Stanisław Laskowski, tribune of the Łuków land, with the magnificent (Magn.) Joanna née Stoińska, and granddaughter of the late magnificent (Magn.) Helena z Lasków Leżeńska – by her first marriage, and by her second marriage of the illustrious (Illustr.) Zygmunt z Parysowa Parys, castellan of Czersk [the reading of the office uncertain] – with the assistance of that same magnificent (Magn.) Borzechowski, tribune of Bracław, her husband, being of sound mind and body, deposed that out of the principal sum of fifteen thousand Polish złoty – first and originally inscribed by the late illustrious (Illustr.) Zygmunt Parys, castellan of Czersk, before the castle court records of Stężyca on the Friday after the feast of St Valentine the Martyr in the Year of Our Lord one thousand six hundred and forty-six, to the magnificent (Magn.) Helena z Lasków Leżeńska, huntress of Lublin, her grandmother, by way of a simple debt, and secured upon the estates of the village of Kozłów together with the manor farms situated in it, upon the whole village of Borki Piotelskie [uncertain reading] and upon the half of the town of Parysów, and fallen to her, the deponent, by divine right and natural succession – and likewise out of the sum of interest, in the part falling to her as against the other lawful co-participants and successors, that is the well-born (Gen.) brothers and the present sister-cessionary; moreover out of any process whatsoever in that matter, broken off by the death of the late magnificent (Magn.) Stanisław Laskowski, tribune of Łuków; as also out of the inscription itself together with the ready warranty and eviction, the penalty, the bonds and the conditions, and out of the whole right to those sums – leaving nothing to her successors – she yields up and transfers, from now and in fact, to the magnificent (Magn.) Hilaria née Laskowska, by her first marriage the lawful wife of the late magnificent (Magn.) Stanisław de Lubomierz, and by her second and present marriage of the magnificent (Magn.) Wiktoryn z Cieszkowa Cieszkowski, land clerk of Łuków, her sister german, and to her lawful successors, that whole and entire right of hers, both as regards the principal sum and as regards the sum of interest, seated upon those same estates of Kozłów and Parysów in the manner described above.

The noble (Nob.) Karol Radzikowski, son begotten of the late well-born (Gen.) Wojciech Radzikowski with the well-born (Gen.) Anna née Niewęgłowska, in his last marriage, heir of certain estates, that is of an inheritance share lying in the hereditary villages of Olszewnica, Krasowska Paszki Lichty [uncertain reading] and Niewęgłosz – endowed by the daughter of the late well-born (Gen.) Maciej Aleksander Niewęgłowski, and now the purchaser from the well-born (Gen.) Ludwika née Niewęgłowska Śmietanczyna, [wife] of the late well-born (Gen.) Józef Śmietanka, and from Magdalena, likewise née Niewęgłowska, wife of the late well-born (Gen.) Kazimierz Stocki Gryczan, as to their portions – on the one side;

and the well-born (Gen.) Teresa née Niewęgłowska Olszewska with the well-born (Gen.) Sebastian Olszewski, her husband, and their heirs; the well-born (Gen.) Marianna née Niewęgłowska Czerniewiczowa with the well-born (Gen.) Franciszek Czerniewicz, her husband, heirs of the estates described above, that is Karol Czerniewicz and Anna Czerniewiczówna, in her last marriage wife of the noble (Nob.) Aleksander Wysokiński, brother and sister, perpetual purchasers of the right to those same estates; and Marcin Niewęgłowski, son of the late well-born (Gen.) Stanisław Niewęgłowski, son of the former Andrzej – in his own name and in the name of the well-born (Gen.) Eufrozyna, now wife of the well-born (Gen.) Józef Niewęgłowski, for whom he stands surety – on the other side,

being of sound mind and body, deposed and acknowledged that they, wishing to avoid costs and to allay the dispute begun between them, brought or to be brought before the castle court office of the starosta of Łuków, together with all the suits and claims at law, whatsoever might arise by title of the connection of those same estates and of the inheritance share – which, hitherto held and seized wilfully by whatsoever possessors, justly and lawfully belong to the noble (Nob.) Karol Radzikowski, in the strongest form of law perpetually resigned by the heirs named above and devolved upon him – choose and inscribe as supreme judge and umpire (superarbiter) the magnificent (Magn.) Jan de Borzec Borzechowski, tribune of Bracław, giving and granting him the power of a solemn determination, and this for the Monday after Misericordia Sunday of the present year 1744, upon the ground of the estates named above […]
