The very reverend (Adm. Rev.) Father Franciszek de Boratyn Boratyński, provost and official of Łuków, being of sound mind and body, deposed that he gives a quittance to the well-born (Gen.) Stanisław and Zuzanna née Krzeska – by her first marriage the wife of the late well-born (Gen.) Tomasz Domański, and now by her second marriage Borowska – husband and wife, and likewise to the nobles (Nob.) Paweł Gołaski, Jan Zarzecki and Elżbieta, widow left by the late noble (Nob.) Wojciech Zarzecki, the mother, and Jan and Józef, the sons, Zarzecki, as also to their successors, for the following sums: the well-born (Gen.) Borowski – for three hundred and sixty złoty; the noble (Nob.) Jan Zarzecki – for twenty-eight złoty and six groszy; Paweł Gołaski – for forty złoty and twelve Polish groszy; and the successors of the late noble (Nob.) Wojciech Zarzecki – for seventeen złoty and twenty-nine Polish groszy; and this on account of the tithe in arrears due to the parish church of Łuków, adjudged by a decree of condescension issued by the present office on the ground of the estate of Zarzecz and lodged with the present records by way of oblation, contained in an act of this day, and likewise for the penalty enjoined by that same decree – by reason of the payment actually made; and the enforcement clause of that decree as regards payment he cancels. And immediately thereafter, since the said well-born (Gen.) Stanisław Borowski and his lawful successors have discharged the sum of three hundred and sixty Polish złoty – due to the deponent on account of the tithe, and now paid by that same well-born (Gen.) Borowski, who holds possession of those estates, by virtue of the decree of condescension cited above – he therefore cedes to him, with everything, his whole and undiminished right to the above; giving him power to receive that sum and to pursue it in the ordinary course of law from whomsoever it shall be lawfully due.

Before the present castle court records of Łuków, having appeared in person, the religious (Relig.) in Christ Father Michał Koszelnicki, of the Order of Friars Minor Observant of St Francis, of the convent of Łuków, with the assistance of the renowned (Fam.) Jakub Gundasiewicz [uncertain reading], syndic of that same convent, being of sound mind and body, deposed that to the well-born (Gen.) Zuzanna, daughter of the late well-born (Gen.) Antoni Krzeski, begotten of the late well-born (Gen.) Marianna née Zarzecka, daughter of the well-born (Gen.) Jan Stanisław Zarzecki, tribune of the Łuków land and deputy starosta of the Łuków castle court, by her first marriage the wife of the late well-born (Gen.) Tomasz Domański and now by her second marriage the lawful wife of the well-born (Gen.) Stanisław Borowski, and likewise to Marcjan [uncertain reading], Wawrzyniec, Sebastian and Kazimierz Domański, the sons begotten with the first husband, and to their successors — for the sum of two hundred and forty Polish złoty, by force of the composition (komplanacja) concluded and written down under the act and date of the 4th day of April in the Year of Our Lord 1742 and lodged by way of oblation with the records of the present office on the Tuesday after Low Sunday of that same year — which sum the above-named late well-born (Gen.) Zarzecki, tribune of the land and deputy starosta of the Łuków castle court, bequeathed to that same convent by the testament of his last will, written down under the act and date of the 15th day of April in the Year of Our Lord 1705 in the estate of Zarzec and lodged by way of oblation with the records of the present office on the Monday after Exaudi Sunday of that same year, and which sum, from the time of that testament until the year one thousand seven hundred and forty-one, remained withheld and secured for payment — the said sum of two hundred and forty Polish złoty having in fact been paid through the hands of the well-born (Gen.) Stanisław Borowski, the husband, in his own name and in the name of that same convent of Łuków, for whose ratification he stands surety — he gives a quittance. Moreover, that same sum, paid to him, he cedes and by cession transfers to that same well-born (Gen.) Stanisław Borowski and to his lawful successors, together with the whole and entire right belonging to it, giving power to recover the said sum of two hundred and forty Polish złoty from whomsoever it is lawfully due, to take up what is recovered, to give a quittance for what is taken up and to pursue it by the ordinary course of law.

Having appeared in person before the present castle court records of Łuków, the well-born (Gen.) Barbara Szabrańska, daughter of the well-born (Gen.) Antoni Szabrański, begotten with the late well-born (Gen.) Franciszka Krzeska, and wife of the well-born (Gen.) Wojciech Kossowski, with the assistance of that husband of hers, being of sound mind and body, deposed that to the well-born (Gen.) Józef Szabrański, her brother german, and to his successors, she gives and donates her maternal hereditary estates, that is her whole and entire inheritance shares, falling to her as against the other brothers – in the plots, buildings, all edifices, gardens, orchards, arable, fields, meadows, woods, forests, groves, rivers, streams, oak woods, and likewise in the subjects, cottagers, gardeners and lodgers with their wives, children, cattle and swine, together with all their property and household implements, as also in the arable, fields and meadows held and possessed by her, in the day-labours, tributes, dues and all the services, and moreover in everything else adjacent and belonging to those inheritance shares – reserving and excepting nothing for herself or for her successors, but as widely and as long as those inheritance shares stood and stand of old within their baulks and boundaries, lying and situated in the hereditary estate of the village of Zarzecze, with everything [continued on scan 073].

The well-born (Gen.) Stanisław Borowski, in his own name and in the name of the well-born (Gen.) Zuzanna née Krzeska, his wife, and likewise of Wawrzyniec, Sebastian and Kazimierz Domański, his stepsons, on the one side, and Krzysztof Świderski, in his own name and in the name of Marianna née Niewęgłowska, his wife, and likewise of Stanisław, Barbara and Ludwika, his children, on the other side – for the ratification of all of whom they stand surety – being of sound mind and body, deposed that mutually and reciprocally they give a quittance to one another and to their successors for all the suits and official actions concerning certain claims and acts of violence inflicted upon one another, brought and intended before the present office; for all and each of the manifestations, relations, decrees of whatsoever kind and entries in the dependent registers, arising from whatsoever source and arisen up to this day – not excepting the decree of condescension issued on the ground of the estate of [the name – uncertain reading] on the Wednesday, the morrow of the feast of the Visitation of the Blessed Virgin Mary in the Year of Our Lord 1743 – (saving, however, the enforcement clause as regards the sum of fifty Polish złoty, contained in that same decree of condescension); and the protestations, the relations and the decrees of whatsoever kind, together with whatsoever condemnations, they cancel, in their entirety and with the whole process.

The well-born (Gen.) Stanisław Szaniawski, son of the late well-born (Gen.) Andrzej Szaniawski, hunter [the reading of the office uncertain], being of sound mind and body, deposed that to the well-born (Gen.) Józef Szabrański, the son begotten in the second bed of the late well-born (Gen.) Antoni Szabrański with the late well-born (Gen.) Franciszka Krzeska, and to his successors he gives and donates all and each of his hereditary estates, due to him by whatsoever title of right as against the other co-successors – in the plots, the buildings and any structures whatsoever, gardens, arable, fields, meadows, woods, forests, groves, rivers and streams, and likewise with the subjects, the inhabitants, the gardeners and the cottagers, together with their wives, children, cattle and swine, with the whole household property and the farming gear, as also with the arable, the fields and the meadows held and possessed by them, with the days of labour service, the day and night boon-works and all the subject obedience rendered of old, with the tributes, the renders and all the dues, with the tavern and the tavern-keeper, and with the other appurtenances and appendages of those same estates – leaving and excepting nothing for himself or for his successors – situated and lying in the hereditary village of Zarzec, with everything. He consented to intromission forthwith and promised a general legal warranty, and this under the land-law damages and under the present court.

The magnificent (Magn.) Stanisław, son of the late magnificent (Magn.) Jan Stanisław, of two given names, Beydo Rzewuski, hunter of Podlasie, pantler of the Łuków land, on the one side, and Andrzej, son of the late Stanisław Rzewuski, treasurer of Bracław, on the other side, the Rzewuski, being of sound mind and of good understanding, deposed that mutually and reciprocally they give land for land, ground for ground, inheritance for inheritance, making between themselves the following exchange (commutatio):

and namely the magnificent (Magn.) Stanisław Rzewuski, pantler of the Łuków land, to the magnificent (Magn.) Andrzej Rzewuski – his hereditary estate, that is a hide of arable, beginning at the village road and running towards the Grochówka boundaries, between the baulks of that same magnificent (Magn.) Andrzej Rzewuski, the present party exchanging, on the one side, and, on the other, the part now remaining in the possession of the noble (Nob.) Józef Szorc, Remigiusz Krzeski and others, that is half a hide;

and in return, in exchange, the magnificent (Magn.) Andrzej Rzewuski, the treasurer, according to the agreement described above, to the magnificent (Magn.) Stanisław Rzewuski, pantler of the Łuków land, and to his successors – his hereditary estate, that is a hide of arable, beginning at the village road and running towards the Wesołka and Grochówka boundaries, on the borderland, between the baulks of the magnificent (Magn.) Stanisław Rzewuski, the party exchanging, on the one side, and, on the other, [a passage struck out], with three strips joined to that same hide over four stadia of length, by the paved road running from the estate of Krzesk to the village of Wesołka –

situated and lying in the hereditary estate of the village of Krzesk Królowa Niwa, with everything, they give, donate, that is exchange. They consented to intromission forthwith and promised warranty, and this under the land-law damages and the present forum.

The well-born (Gen.) Wawrzyniec, Sebastian and Kazimierz Domański, sons of the late well-born (Gen.) Tomasz Domański begotten with the late well-born (Gen.) Zuzanna née Krzeska in her first marriage – she being thereafter, after the late Domański, in her second marriage the wife of the well-born (Gen.) Stanisław Borowski, with whom she begot children of the younger bed – on the one side, and the well-born (Gen.) Stanisław Borowski on the other side, being of sound mind and body, deposed that they – for the composing and the final determination of whatsoever claims arisen between them on both sides upon any title – choose, appoint and solemnly accept as supreme judge and umpire (superarbiter) the magnificent (Magn.) Krzysztof a Gołąbki Jezierski, starosta of Gródek, giving and granting to him, together with two arbiters set up two on each side, full power and entire authority:

to come upon the ground of the estate [the name of the village struck out in the manuscript] on the Tuesday after the feast of the Conversion of St Paul the Apostle in the coming year 1744 [28 January 1744] and there to bring the matter to an end; to examine and to determine the donations of both sides, the rights, the inscriptions and the documents; to carry through an inquiry as to the sums and as to the movable and self-moving goods, both after the late well-born (Gen.) Tomasz Domański and after the well-born (Gen.) Borowski, and to order restitution to him to whom it is due; and to determine all and each of the claims of both sides so that nothing shall remain uncleared for the future.

Promising withal and undertaking that all that, whatsoever shall be adjudged by the said umpire and arbiters and determined as right and just, they will hold as valid and agreeable and will approve – and this under the land-law damages, upon a simple word, appointing for answering the court of the present office.
