Stoiński

Before the subdelegate, the magnificent (Magn.) Roch Klembowski, sword-bearer of the Łuków land. — Having appeared in person, the well-born (Gen.) Paweł Wysokiński, son of the late noble (Nob.) Piotr called Jagiełka, being of sound body and mind, deposed that to the magnificent (Magn.) Paweł Stoiński, deputy cup-bearer of the [Łuków] land and vice-starosta of the Łuków castle court, and to his successors, his estate, that is the industrious (Labor.) Kazimierz Piechowiec, his subject, resigned to him by perpetual right by the noble (Nob.) Jakub Leszczyński, together with the whole of that subject's property, he gave, donated, inscribed in perpetuity and resigned by hereditary title. Giving and granting to that donee of his full power and every and absolute authority to hold and to have that subject and to settle him upon his own estates.

The well-born (Gen.) Antonina née Rozwadowska Sobolewska, widow left by the late well-born (Gen.) Franciszek Sobolewski, deputy cup-bearer of Nur, being of sound mind and body, deposed that to the well-born (Gen.) Andrzej Szabrański, son of the late well-born (Gen.) Seweryn, and to his successors – in satisfaction of the contract drawn up and officially confirmed today – she cedes with every right the sum of three thousand Polish złoty, out of the original sum of ten thousand Polish złoty inscribed to her earlier by the magnificent (Magn.) Dominik Stoiński, sword-bearer of the district of Urzędów and castle judge of Lublin, by way of a simple debt, at Lublin in the ordinary courts of the Illustrious Tribunal of that same year, on the Saturday on the eve of the feast of St Bartholomew the Apostle in the Year of Our Lord 1738 [23 August 1738], and secured for payment together with the interest, and falling to her; giving and granting him leave to raise that sum, to give a quittance for what is raised, and, should need arise, to pursue it at law in any court and office whatsoever – by means of the present deposition.

The magnificent (Magn.) Franciszka née Laskowska, lawful wife of the magnificent (Magn.) Jan Borzechowski, tribune of Bracław, daughter begotten of the late magnificent (Magn.) Stanisław Laskowski, tribune of the Łuków land, with the magnificent (Magn.) Joanna née Stoińska, and granddaughter of the late magnificent (Magn.) Helena z Lasków Leżeńska – by her first marriage, and by her second marriage of the illustrious (Illustr.) Zygmunt z Parysowa Parys, castellan of Czersk [the reading of the office uncertain] – with the assistance of that same magnificent (Magn.) Borzechowski, tribune of Bracław, her husband, being of sound mind and body, deposed that out of the principal sum of fifteen thousand Polish złoty – first and originally inscribed by the late illustrious (Illustr.) Zygmunt Parys, castellan of Czersk, before the castle court records of Stężyca on the Friday after the feast of St Valentine the Martyr in the Year of Our Lord one thousand six hundred and forty-six, to the magnificent (Magn.) Helena z Lasków Leżeńska, huntress of Lublin, her grandmother, by way of a simple debt, and secured upon the estates of the village of Kozłów together with the manor farms situated in it, upon the whole village of Borki Piotelskie [uncertain reading] and upon the half of the town of Parysów, and fallen to her, the deponent, by divine right and natural succession – and likewise out of the sum of interest, in the part falling to her as against the other lawful co-participants and successors, that is the well-born (Gen.) brothers and the present sister-cessionary; moreover out of any process whatsoever in that matter, broken off by the death of the late magnificent (Magn.) Stanisław Laskowski, tribune of Łuków; as also out of the inscription itself together with the ready warranty and eviction, the penalty, the bonds and the conditions, and out of the whole right to those sums – leaving nothing to her successors – she yields up and transfers, from now and in fact, to the magnificent (Magn.) Hilaria née Laskowska, by her first marriage the lawful wife of the late magnificent (Magn.) Stanisław de Lubomierz, and by her second and present marriage of the magnificent (Magn.) Wiktoryn z Cieszkowa Cieszkowski, land clerk of Łuków, her sister german, and to her lawful successors, that whole and entire right of hers, both as regards the principal sum and as regards the sum of interest, seated upon those same estates of Kozłów and Parysów in the manner described above.

The noble (Nob.) Krystyna née Domańska, by her first marriage the wife of the late noble (Nob.) Jan Przygocki, and after him by her second marriage the wife of the noble (Nob.) Maciej Rzymowski – by reason of the absence of her husband, who lies in bed sick – with the assistance of the nobles (Nob.) Andrzej Domański and likewise Jan Domański, and with their present consent to the acts described below, in her own name and in the name of the nobles (Nob.) Franciszek, Marianna and Joanna Przygocki, the son and the daughters born of the first bed, for whose ratification she stands surety, on the one side;

and the nobles (Nob.) Władysław Kisieliński and Kacper Skrzyszewski called Skorupka on the other side, being of sound mind and body, deposed that they – for the composing and the final determination of the suit and action over the hastening of death (acceleratio fatorum) in the person of the late noble (Nob.) Jan Przygocki, husband of the noble (Nob.) Krystyna née Domańska of the first bed, brought against the nobles (Nob.) Skrzyszewski and Kisieliński before the Łuków castle court office – choose as supreme judge and umpire (superarbiter) the magnificent (Magn.) Paweł Stoiński, deputy cup-bearer of the Łuków land and vice-starosta of the Łuków castle court, appointing him for this day at Łuków the place of the meeting, together with the arbiters whom each of the parties is to set up on its own side; that suit, according to the terms issued and the protestations, he is to carry through in full and finally to judge, and what he shall hold to be right and just, to that the parties are bound to be obedient and by that to abide – and this under a penalty of two hundred Polish marks, for which they appoint the forum of the present office.
