Koszelnicki

The religious (Relig.) in Christ Father Michał Koszelnicki, of the Order of Friars Minor of St Francis Observant, guardian of the convent of Łuków, in his own name and in the name of the convent of Łuków, for whose ratification he stands surety, being of sound mind and body, deposed that he gives a quittance to the noble (Nob.) Stanisław Okniński and to the noble (Nob.) Kazimierz, his son, and to their successors for the sum of one hundred Polish złoty – adjudged, together with the interest and the luitum (lucta) penalty, and enjoined to be paid, by a decree of the present office issued in the terms for complaints (the courts of suits) on the Monday after the feast of the Assumption of the Most Glorious Virgin Mary in the Year of Our Lord 1742, between that same convent on the one side and the party quitted on the other – and this because both the original sum and the interest have in fact been paid out to him. He gives him a quittance also for the suit and official action brought on that account and for the enforcement clause of the decree described above; that process he cancels.

Before the present castle court records of Łuków, having appeared in person, the religious (Relig.) in Christ Father Michał Koszelnicki, of the Order of Friars Minor Observant of St Francis, of the convent of Łuków, with the assistance of the renowned (Fam.) Jakub Gundasiewicz [uncertain reading], syndic of that same convent, being of sound mind and body, deposed that to the well-born (Gen.) Zuzanna, daughter of the late well-born (Gen.) Antoni Krzeski, begotten of the late well-born (Gen.) Marianna née Zarzecka, daughter of the well-born (Gen.) Jan Stanisław Zarzecki, tribune of the Łuków land and deputy starosta of the Łuków castle court, by her first marriage the wife of the late well-born (Gen.) Tomasz Domański and now by her second marriage the lawful wife of the well-born (Gen.) Stanisław Borowski, and likewise to Marcjan [uncertain reading], Wawrzyniec, Sebastian and Kazimierz Domański, the sons begotten with the first husband, and to their successors — for the sum of two hundred and forty Polish złoty, by force of the composition (komplanacja) concluded and written down under the act and date of the 4th day of April in the Year of Our Lord 1742 and lodged by way of oblation with the records of the present office on the Tuesday after Low Sunday of that same year — which sum the above-named late well-born (Gen.) Zarzecki, tribune of the land and deputy starosta of the Łuków castle court, bequeathed to that same convent by the testament of his last will, written down under the act and date of the 15th day of April in the Year of Our Lord 1705 in the estate of Zarzec and lodged by way of oblation with the records of the present office on the Monday after Exaudi Sunday of that same year, and which sum, from the time of that testament until the year one thousand seven hundred and forty-one, remained withheld and secured for payment — the said sum of two hundred and forty Polish złoty having in fact been paid through the hands of the well-born (Gen.) Stanisław Borowski, the husband, in his own name and in the name of that same convent of Łuków, for whose ratification he stands surety — he gives a quittance. Moreover, that same sum, paid to him, he cedes and by cession transfers to that same well-born (Gen.) Stanisław Borowski and to his lawful successors, together with the whole and entire right belonging to it, giving power to recover the said sum of two hundred and forty Polish złoty from whomsoever it is lawfully due, to take up what is recovered, to give a quittance for what is taken up and to pursue it by the ordinary course of law.

That same [Father Michał Koszelnicki], with the assistance of the same person as above, in his own name and in the name of the whole of the said convent, being of sound mind and body, deposed that to the industrious (Labor.) Franciszek Kamiński, of Trzembowlice [uncertain reading], and to his successors — for the suit and official action brought before the present office concerning the sum of two hundred and twenty Polish złoty, inscribed in the first place and at its source by the late Kaznowski to the magnificent (Magn.) Jan Jezierski, land judge of Łuków, before the present records, and afterwards ceded by that same magnificent (Magn.) Jezierski to the said convent of Łuków on the Saturday on the eve of the feast of the holy Apostles Peter and Paul in the Year of Our Lord 1670, and already taken up and satisfied by that same convent by means of a quittance made before the present records on the Monday after Exaudi Sunday in the Year of Our Lord 1708 — the suit having been begun and lodged after that sum had been satisfied — and likewise for the condemnation obtained in that respect at certain terms, that is the courts of suits of the present office, on the Monday after the feast of the Assumption of the Most Glorious Virgin Mary in the past year 1742 — he gives a quittance, and that condemnation he cancels in its entirety.
