„Persons (different given names)” means: different combinations of a given name with a byname, not persons proved to have existed. Two namesakes from one family merge here into a single item, and the acts give nothing to tell them apart. An entry naming several families stands beside each of them — because the record names them together, and they must not be separated.

localities in the entry

The noble (Nob.) Marcjanna née Dzierżanowska, by her first marriage the wife of the late well-born (Gen.) Franciszek Rudnicki, by her second and present marriage the wife of the noble (Nob.) Jakub Jastrzębski — by reason of the absence of her husband, who lies laid low by sickness, with the assistance of the well-born (Gen.) Franciszek Borkowski, and freely — being of sound mind and body, deposed that she gives a quittance to the nobles (Nob.) Stanisław and Kazimierz Pogonowski — sons of the late noble (Nob.) Michał Pogonowski, and he [was] the son of the noble (Nob.) **Mateusz Pogonowski** [in the manuscript „quondam Mathiae”; see the notes] — and to their successors, for the suit and official action brought and lodged with the present office on account of the committing of acts of violence against the late noble (Nob.) Adam Dzierżanowski, her paternal cousin [uncertain reading: „sui Fratris Patruelis”, and possibly also „Parentis” — see the notes], by the said persons and by **that same noble (Nob.) Mateusz Pogonowski, their grandfather**, as the present parties quitted; further for the condemnation obtained in that matter, as also for all and each of the claims lasting up to this day and arisen upon that occasion — and this by reason of the settlement concluded between them and of the satisfaction rendered; and the protestation against those same parties quitted and the condemnation she cancels.

notes and marginalia The entry passes from scan 57-036 (f. 35r) to 57-037 (f. 35v); it is joined into one item. The second entry of that day made by the same Marcjanna Jastrzębska, deposing under a substitute assistance by reason of her husband's sickness (cf. 1265, 1268). **The filiation and the given name have been checked three times on scan 57-036 (enlargements of single words).** The manuscript reads: „N.N. Stanislaum et Casimirum Pogonowskie, **ol. N. Michaelis quondam Mathiae Pogonowski filij, filios**”, and further on: „per praefatos et **N. Mathaeum Pogonowski**, modernos Quietatos”. **The reading adopted: Maciej and Mateusz are ONE person — Mateusz Pogonowski, the father of Michał and the grandfather of both quitted brothers.** Four independent reasons speak for it: 1. **The arithmetic of the entry.** The formula „per praefatos **et** N. Mathaeum Pogonowski, **modernos Quietatos**” presupposes **three** offenders and three parties quitted, whereas the heading names by name two brothers. The third is precisely that Mateusz — and not a fourth Pogonowski nowhere introduced. 2. **The want of „olim” at the second mention.** Beside „N. Mathaeum Pogonowski” there is no sign of death, and so that person **is alive** and could have committed an act of violence in 1744. 3. **„Quondam” in this chancery does not prove death, but marks the generation of the grandfather.** The pattern „ol. [ojciec] quondam [dziad] filii filios” recurs three times in a single enumeration of entry no. 1575 („ol. Joannis quondam Alberti filij; ol. Gregorij quondam Nicolai; ol. Joannis quondam Laurentij **filij filij**”), where „quondam” is solely a link in the chain of the generations. It is the context that means death there, and not the word itself. The formula in entry 1284 is of the same build, and so **it does not settle that the father of Michał is not alive**. 4. **The grammatical case decides.** The genitive **„Mathiae”** is ambiguous (the genitive of *Matthias* is Mathiae, that of *Matthaeus* — Mathaei, and the two clusters are alike in this hand), but **the accusative „Mathaeum” is diagnostic**: the accusative of *Matthaeus* is Mathaeum, the accusative of *Matthias* is Mathiam. Since the manuscript has **Mathaeum**, the name is **Mateusz**, and the writing of the genitive „Mathiae” is an ordinary simplification of the clerk. **The skeleton of the kinship is withal certain:** *filios* (accusative plural) refers to Stanisław and Kazimierz, *Michaelis … filij* (genitive singular) to their father, and *Mathiae Pogonowski* to the father of Michał. The line of the generations runs **Mateusz → Michał → Stanisław and Kazimierz**, and the parties quitted are **the two brothers and their grandfather**. The earlier wording of the translation („urodzonego Michała, niegdyś Macieja Pogonowskiego, synów”) allowed of the wrong reading, as though the brothers were the sons of two different persons, and therefore the sentence has been recast. **An alternative reading, noted and rejected:** were „quondam” to be read as a sign of death, the father of Michał would be a dead person, and „N. Mathaeum Pogonowski” — a fourth kinsman nowhere introduced. The PTG tag for scan 57-036 notes one of the persons as **„Maciej lub Mateusz Pogonowski”**, and so the indexer had the same doubt as to the given name; **the discrepancy has not been smoothed over**. **The problem of the pair of names is of a systemic character** — see the note „Matthias czy Matthaeus (Maciej czy Mateusz)” in the sheet „O źródle i metodzie”. **A revision after a fresh reading of scan 57-036 (at the User's request):** (1) **The filiation of the Pogonowski confirmed in full** — in the manuscript: „NN. Stanislaum et Casimirum Pogonowskie ol. N. Michaelis quondam Mathiae Pogonowski filij filios”, and below the accusative **„N. Mathaeum Pogonowski”** (an enlargement of the beginning of the 5th line); the reading **Mateusz → Michał → Stanisław and Kazimierz** and the identity of „Mathiae”/„Mathaeum” stand in force. (2) **Adam Dzierżanowski is dead in the manuscript**: „intentata **ol.** N. Adami Dzierżanoski” — the abbreviation „ol.” has the same build as in „ol. N. Michaelis” two lines above; it was previously overlooked. The manuscript does not say whether the death had any connection with the act of violence — **nothing has been presumed**. (3) **The degree of the kinship**: the earlier „jej krewnego” was a generalisation. The manuscript: „sui Fratris Pa[…]is”. The first word is *Fratris* (after the initial, two low letters before the tall „t”: F-ra-tris, not Pa-tris). The second word ends in a tall letter with a loop before „-is”, which answers to the „l” in **„Patruelis”** — *frater patruelis* = **paternal cousin**, a term used by this chancery many times (entries 1770, 1806, 1843, 1942, 1961, 2039). The alternative reading **„Parentis”** (the tall letter = „t”) would give the phrase „sui Fratris Parentis” — grammatically lame, but not to be excluded; **the reading has been marked as uncertain and both variants recorded**. (4) Franciszek Rudnicki, the first husband, likewise with the abbreviation „ol.” („primarum ol. N. Francisci Rudnicki”) — in accordance with entries 60, 61, 539 of the 1743 volume, where Marcjanna appears as his widow; „zmarłego” has been added. (5) The sigla: Marcjanna — **N.**; Franciszek Borkowski (the assistant) — **G.**; Stanisław and Kazimierz — **NN.**; the late Michał, Mateusz, the late Adam Dzierżanowski — **N.** The formula beside Borkowski: „in assistentia G. Francisci Borkowski et spontanee” — the assistance and the free will. (6) A fragment of the formula after „modernos Quietatos” that has not been read with certainty (the end of the 5th line: „Actione concep…” / the beginning of the 6th: „…nis violentiae attentationis instituta et intentata”) — it concerns the designation of the action, not the persons; it has been rendered generally, as hitherto.
