The nobles (Nob.) Antoni Niewęgłowski and Marianna née Sosnowska – by her first marriage the wife of the late noble (Nob.) Antoni Celiński, and now the wife of that same noble (Nob.) Niewęgłowski – lawful spouses to one another, being of sound mind and body, deposed (and especially the wife with the assistance of her husband), also in the name of the noble (Nob.) Ewa Celińska, her under-age daughter born of the first bed, for whom she stands surety, that to the well-born (Gen.) Ludwik and Anna née Bogucka Kaznowski, husband and wife, further to Wojciech Kaznowski, and to their successors they mortgage the hereditary estates after the late noble (Nob.) Antoni Celiński, subject to their rights, that is nineteen strips of arable, beginning at the Łuków road [uncertain reading] and running towards the headland, between the baulks of the successors of the late noble (Nob.) Józef Klembowski on the one side and of the noble (Nob.) Piotr Klembowski on the other, sown with winter corn, lying in the hereditary village of Klembów, with everything, for the sum of seventy-two Polish złoty and twenty-four groszy, from now until the Monday after Invocavit Sunday in Lent in the current year 1744 [24 February 1744]; and thereafter from one three-year term to another and to the same day. They consented to intromission forthwith and promised warranty, and this under a like penalty of that same sum, for which they appoint the present forum.

The well-born (Gen.) Ludwik Kaznowski and Anna Bogucka, spouses to one another, being of sound mind and body, deposed – and especially the wife with the assistance of her husband – that they, in their own name and in the name of the well-born (Gen.) Wojciech Kaznowski, his brother german, for whom they stand surety, give a quittance to the nobles (Nob.) Antoni Niewęgłowski and Marianna née Sosnowska, lawful spouses to one another, the parents, further to Ewa Celińska, the daughter begotten of the first bed by the late noble (Nob.) Antoni Celiński with that same noble (Nob.) Marianna, now Niewęgłowska, and to their successors –

for the marks and the penalties and payments (luitae), both for the acts of violence committed by the late noble (Nob.) Antoni Celiński, the former husband of the party quitted, and for the transgression of a decree of condescension and for the compensation for wounds (taxa vulnerum), adjudged to the plaintiffs and ordered to be paid by the parties quitted by a decree of the present office in the terms for complaints, that is the courts of the office's suits, handed down on the Monday after the feast of the Assumption of the Most Glorious Virgin Mary of the year just past 1743 [19 August 1743] between the deponents as plaintiffs on the one side and the present parties quitted on the other – by reason of the satisfaction rendered to them in those marks and of their actual payment through the hands of the noble (Nob.) Antoni Niewęgłowski – they give a quittance, and the enforcement clause of that same decree, further the protestations, the relations and the condemnations made and obtained in that matter, they cancel.

Moreover those same marks, specified in the decree noted above with the act, they yield up and cede to the person of the said noble (Nob.) Antoni Niewęgłowski as the one who paid them – giving him every and entire right: to take up those marks, to give a quittance for what is taken up and to pursue them at law against whomsoever it shall be fitting – by virtue of the present deposition.

Thursday next after Ash Wednesday, in the Year of Our Lord 1744.

The noble (Nob.) Antoni Niewęgłowski, son of the late well-born (Gen.) Antoni Niewęgłowski, being of sound mind and body, deposed that to the noble (Nob.) Antoni Sosnowski, son of the noble (Nob.) Mikołaj Sosnowski, and to his successors he is bound and obliged for the sum of one hundred Polish złoty by title of a certain, true, just, liquid and simple debt; which sum he inscribes and secures upon all and each of his estates; and he submits and undertakes to pay that same sum, from now until the feast of the Nativity of St John the Baptist falling in the year, God willing, to come 1746, and to lodge it with the present records, and this under a like penalty of one hundred Polish złoty, for which he appoints the present court. And in case the principal sum be not paid at the promised term, he undertakes to render the interest due upon it, for which he shall be given a quittance.

The noble (Nob.) Stanisław Ryszkowski, being of sound mind and body, deposed that he gives a quittance to the noble (Nob.) Antoni Sosnowski and to his successors – for a certain protestation, made before the present records on the Thursday after Ash Wednesday in the Year of Our Lord 1744 against that same party quitted, and for the relation entered in that same year – and this by reason of the settlement concluded between them; and that same protestation and the term issued he cancels.
