Burski

The well-born (Gen.) Antoni Burski, apostolic notary, [an official] of the consistory of Łuków, though weak in body yet sound in mind, deposed that to the very reverend (Adm. Rev.) Father Jan de Boratyn Boratyński, provost and officialis of Łuków, and to his successors, he cedes a sum of thirty Hungarian red złoty – contracted in the first place by the late magnificent (Magn.) Kacper and Franciszka née Kuropatnicka Załuski, husband and wife, starostas of [the name – uncertain reading], from the well-born (Gen.) Franciszek Stocki, under a certain hand-written bond given at Stanin on 10 November in the Year of Our Lord 1733, and afterwards ceded by the said well-born (Gen.) Franciszek Stocki to him, the deponent, before the present records on the Thursday after the feast of the Immaculate Conception of the Blessed Virgin Mary in the Year of Our Lord 1736 – together with all the conditions, points, clauses, articles, bonds, forum and securities of that bond, having received from the hands of the present cessionary sufficient satisfaction for the above sum; and the whole of that right of his, unimpaired, he transfers, makes over and incorporates in full into the person of the said cessionary, giving and granting full power and all absolute authority to collect that sum of thirty Hungarian red złoty (together with the interest), to give a quittance for its receipt, and if need be to pursue it at law.

The noble (Nob.) Józef Klembowski, son of the late noble (Nob.) Maciej, being of sound mind and body, deposed that to the well-born (Gen.) Antoni and Marianna née Burska Stypiński, spouses of one another, and to their successors he cedes the sum of five hundred Polish złoty – awarded to the deponent in the first place by a decree of compromise (of the arbitration court), and afterwards adjudged and enjoined to be paid, together with the luitum (lucta) penalty of fourteen Polish marks, by a decree given in the terms for complaints (the courts of suits) of the present office on the Monday after the feast of the Assumption of the Most Glorious Virgin Mary in the Year of Our Lord one thousand seven hundred and forty-two, between the deponent and the present cessionaries – and this because the present cessionaries have in fact paid out that sum together with the penalty, after the deduction of two Hungarian red złoty, to him, the deponent, according to the tenor of the decree cited. The cession takes in all the conditions both of the original inscription as to that sum and of the decrees; he gives and grants the power to pursue that sum together with the penalty, to receive it and to give a quittance for the receipt. Moreover that same deponent undertakes and binds himself to defend and to warrant those same cessionaries against all hindrances in the keeping of that sum, in every court and office, upon all his estates, together with his successors.
