Garwoliński

The noble (Nob.) Jan Grodzicki, son of the late noble (Nob.) Józef, being of sound mind and body, deposed that to the well-born (Gen.) Franciszek Garwoliński and to the well-born (Gen.) Franciszek, the son, and to their successors he is bound and obliged for the sum of twenty-seven Polish złoty on account of a certain, true, just, liquid and simple debt; that sum he inscribes and secures upon his estates subject to the same party by right of mortgage, and he undertakes to pay that sum and to lodge it with the present records at the same time when he shall redeem the original sum by virtue of the mortgage inscription. And this under a penalty of twenty-seven Polish złoty and the present forum.

[Heading of the session:] On the Wednesday on the eve of the feast of the Most Holy Body of Christ Our Lord, of that same year 1743 [12 June 1743].

The magnificent (Magn.) Antoni – a companion of the armoured banner of the magnificent (Magn.) Potocki, starosta of Grabowiec – and Tomasz Szaniawski, sons of the late magnificent (Magn.) Stanisław Szaniawski, tribune of Lublin, brothers german to one another, in their own name and in the name of the magnificent (Magn.) Kazimierz Szaniawski, their brother german, for whose peace they stand surety, on the one side, and the well-born (Gen.) Franciszek Garwoliński on the other side, being of sound mind and body, deposed that a certain contract of resignation, on account of certain conditions expressed in it, drawn up and dated here at Łuków on the 12th day of June of that same year, written down between themselves the deponents, signed by the hands of friends and secured by damages [in case of non-performance] – they strengthen and confirm (they approve) in everything, and this under the land-law damages and under the jurisdiction of the present office, by means of the present deposition.

The magnificent (Magn.) Antoni – a companion of the armoured banner of the magnificent (Magn.) Potocki, starosta of Grabowiec – and Tomasz, the Szaniawskis, sons of the late magnificent (Magn.) Stanisław Szaniawski, tribune of Lublin, brothers german to one another, in their own name and in the name of the magnificent (Magn.) Kazimierz Szaniawski, their brother german, for whose peace they stand surety, being of sound mind and body, deposed that to the well-born (Gen.) Franciszek Garwoliński, son of the late well-born (Gen.) Franciszek Garwoliński, and to his successors they are bound and obliged for the sum of one thousand five hundred Polish złoty by way of a certain, true, just, liquid and simple debt;

which sum they inscribe and secure upon all their estates, and especially upon Chomejowa Wola [uncertain reading], and they undertake and bind themselves to pay that sum at the feast of the Nativity of St John the Baptist falling in the coming year 1744 [24 June 1744] and to lodge it with the records of the present office;

and should the original sum not be paid at the term set out above – from then on they offer and inscribe themselves to render to their creditor an interest of seven per hundred yearly, until the actual payment of the original sum; and this under a like penalty of one thousand five hundred Polish złoty and under the jurisdiction of the present office.

The well-born (Gen.) Franciszek Garwoliński, being of sound mind and body, deposed that to the magnificent (Magn.) Antoni – a companion of the armoured banner of the magnificent (Magn.) Potocki, starosta of Grabowiec – to Tomasz and to Kazimierz Szaniawski, sons of the late magnificent (Magn.) Stanisław Szaniawski, tribune of Lublin, brothers german to one another, and to their successors, he gives and donates his estates – resigned to him earlier by perpetual right by the magnificent (Magn.) Jerzy Grodzicki before these same records on the Wednesday after Judica Sunday in Lent in the Year of Our Lord 1740 [6 April 1740] – that is his whole and entire share in the homestead, the arable, the fields, meadows, woods, forests, groves, rivers and streams, and likewise in the buildings and all structures, gardens, orchards and the other appurtenances and appendages of those estates, lying and situated in the village of Bełna, with every right; he consents to intromission from now on for the future and submits to the court, and this under the land-law damages and under the jurisdiction of the present office.

The same [Franciszek Garwoliński], being of sound mind and body, deposed that to the same [Szaniawskis] and to their successors he cedes the sums specified below, namely:

the first – of two hundred and fifty Polish złoty, [inscribed] to him earlier by the magnificent (Magn.) Tomasz Jezierski, in his own name and in the name of his brother, by means of an acknowledgement of the original inscriptions, before the present records on the Saturday after Judica Sunday in Lent in the Year of Our Lord 1740 [9 April 1740];

the second – of five hundred Polish złoty, [inscribed] by the magnificent (Magn.) Jan Grodzicki by that same act indicated above;

the third – of one hundred Polish złoty, [inscribed] by that same magnificent (Magn.) Jan Grodzicki, added to the above-named sum of five hundred złoty, before the present records on the Friday after Exaudi Sunday of that same year 1740 [3 June 1740];

and the fourth – of twenty-seven Polish złoty, [inscribed] by the often-mentioned magnificent (Magn.) Jan Grodzicki, on the Wednesday after Laetare Sunday in Lent of the current year 1743 [27 March 1743] before those same records –

both by way of obligation and by way of addition, inscribed and acquired upon the estates in the hereditary village of Bełna, together with all the conditions of those inscriptions; and this, in satisfaction of the contract officially confirmed today, he cedes and transfers all [the rights]; he consents to intromission from now on for the future and submits, both in the matter and in his own person, to the court, and this under a like penalty of the sum of eight hundred and seventy-seven Polish złoty in all and under the jurisdiction of the present office.

The same [Franciszek Garwoliński] gives a quittance to the same [Szaniawskis] and to their successors for the sum of six hundred Polish złoty – [owed] to him earlier by the late magnificent (Magn.) Stanisław Szaniawski, the father of the parties quitted, under a hand-written (private) contract drawn up under the date of the 9th day of September in the Year of Our Lord 1740, and secured upon the industrious (Labor.) Andrzej Rosa, a subject – and that contract, together with its clauses, he cancels.

The noble (Nob.) Jan Grodzicki, son of the late noble (Nob.) Józef Grodzicki, being of sound mind and body, deposed that to the well-born (Gen.) Franciszek Garwoliński and to the well-born (Gen.) Franciszek Garwoliński likewise, the son, and to his successors, he gives and donates, with everything, his hereditary estates, that is: eighteen strips of garden, that is of plot, beginning at the Ulan road, that is the village road, and running towards the Zapłotnia road, between the baulks of the successors of the late magnificent (Magn.) Stanisław Szaniawski, tribune of Lublin, on both sides; further, three strips of arable at Łabików [the reading of the name uncertain], beginning at the Paskudy boundary and running towards the Białka boundaries, between those same baulks; further, at Wierzchowiny seven strips of arable, beginning at the Paskudy boundary and running towards the Białka boundaries, between the baulks of the noble (Nob.) Tomasz Bedliński on the one side and of the successors of the late magnificent (Magn.) Szaniawski, tribune of Lublin, on the other – situated and lying in the hereditary village of Belna. He consents to intromission forthwith and promises warranty, and this under the land-law damages and under the present court.
